2009-S4850 (ACTIVE) - Summary
Provides that the weekly benefit which a disabled employee is entitled to receive for disability commencing on or after July 1, 2010 and prior to July 1, 2011 such benefit shall be one-half of the employee's weekly wage, but in no case shall such benefit exceed $380; provides that on and after July 1, 2011 the benefit shall be one-half of the employee's weekly wage, but in no case shall such benefit exceed $440.

BILL NUMBER: S4850 TITLE OF BILL : An act to amend the workers' compensation law, in relation to increasing the maximum weekly benefit payable to a disabled employee PURPOSE : This bill seeks too increase the amount of weekly disability payments under the workers' compensation law. SUMMARY OF PROVISIONS : This bill would amend subdivision 2 of Section 204 of the Workers' Compensation Law, to increase the maximum weekly benefit payable to a disabled employee, as follows: A disabled employee would be entitled to receive for disability commencing: (1) on or after July 1, 2010 to July 1, 2011; One-half of the employee's weekly wage, but not more than $380; (2) on or after July 1, 2011; One-half of the employee's weekly wage, but not more than $400, except that if the employee's average weekly wage is less than twenty dollars, then such benefit shall be such

LEIBELL -- read twice and ordered printed, and when printed to be committed to the Committee on Labor AN ACT to amend the workers' compensation law, in relation to increasing the maximum weekly benefit payable to a disabled employee THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 204 of the workers' compensation law, as amended by chapter 38 of the laws of 1989, is amended to read as follows: 2. THE WEEKLY BENEFIT WHICH THE DISABLED EMPLOYEE IS ENTITLED TO RECEIVE FOR DISABILITY COMMENCING (I) ON OR AFTER JULY FIRST, TWO THOU- SAND TEN AND PRIOR TO JULY FIRST, TWO THOUSAND ELEVEN SHALL BE ONE-HALF OF THE EMPLOYEE'S WEEKLY WAGE, BUT IN NO CASE SHALL SUCH BENEFIT EXCEED THREE HUNDRED EIGHTY DOLLARS, AND (II) ON OR AFTER JULY FIRST, TWO THOU- SAND ELEVEN SHALL BE ONE-HALF OF THE EMPLOYEE'S WEEKLY WAGE, BUT IN NO CASE SHALL SUCH BENEFIT EXCEED FOUR HUNDRED FORTY DOLLARS; EXCEPT THAT IF THE EMPLOYEE'S AVERAGE WEEKLY WAGE IS LESS THAN TWENTY DOLLARS, THE BENEFIT SHALL BE SUCH AVERAGE WEEKLY WAGE. The weekly benefit which the disabled employee is entitled to receive for disability commencing on or after May first, nineteen hundred eighty-nine shall be one-half of the employee's weekly wage, but in no case shall such benefit exceed one hundred seventy dollars; except that if the employee's average weekly wage is less than twenty dollars, the benefit shall be such average weekly wage. The weekly benefit which the disabled employee is entitled to receive for disability commencing on or after July first, nineteen hundred eighty-four shall be one-half of the employee's weekly wage, but in no case shall such benefit exceed one hundred forty-five dollars; except that if the employee's average weekly wage is less than twenty dollars, the benefit shall be such average weekly wage. The weekly bene- fit which the disabled employee is entitled to receive for disability commencing on or after July first, nineteen hundred eighty-three and EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
