BILL NUMBER: S4853 TITLE OF BILL : An act to amend the executive law, in relation to local disaster preparedness plans PURPOSE OF BILL : This bill would require counties to include in their existing disaster preparedness plans to include sections. SUMMARY OF SPECIFIC PROVISIONS : Section one of this bill would amend the Executive Law by adding to the definition of disaster to include an act of biological, chemical or radiological terrorism. Section two of this bill would further amend the Executive Law to require Counties to include in their existing disaster preparedness plans the following: *A roster of volunteer medical personnel within the county who would help in case of a disaster along with a plan to coordinate them;

LEIBELL -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Homeland Securi- ty and Military Affairs AN ACT to amend the executive law, in relation to local disaster preparedness plans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph a of subdivision 2 of section 20 of the executive law, as amended by chapter 781 of the laws of 1988, is amended to read as follows: a. "disaster" means occurrence or imminent threat of wide spread or severe damage, injury, or loss of life or property resulting from any natural or man-made causes, including, but not limited to, fire, flood, earthquake, hurricane, tornado, high water, landslide, mudslide, wind, storm, wave action, volcanic activity, epidemic, air contamination, blight, drought, infestation, explosion, radiological accident, water contamination, ACT OF TERRORISM INCLUDING BIOLOGICAL, CHEMICAL OR RADIO- LOGICAL TERRORISM, bridge failure or bridge collapse. S 2. Subdivision 6 of section 23 of the executive law, as added by chapter 640 of the laws of 1978, is amended to read as follows: 6. All plans for disaster preparedness developed by local governments or any revisions thereto shall COMPLY WITH THE NATIONAL INCIDENT MANAGE- MENT SYSTEM (NIMS) AND be submitted to the commission by December thir- ty-first of each year to facilitate state coordination of disaster oper- ations. S 3. Subparagraph 4 of paragraph a of subdivision 7 of section 23 of the executive law, as added by chapter 640 of the laws of 1978, is amended and eight new subparagraphs 5, 6, 7, 8, 9, 10, 11 and 12 are added to read as follows: (4) such other measures as reasonably can be taken to prevent disas- ters or mitigate their impact[.]; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
