Authorizes charitable organizations and not-for-profit corporations which are located within a fifty mile radius of the Indian gaming operation to increase the amount of prize money for games of chance or bingo to an amount that is consistent with or identical to amounts approved for Indian gaming.

BILL NUMBER: S4886 TITLE OF BILL : An act to amend the executive law, the general municipal law, the benevolent orders law, and the not-for-profit corporation law, in relation to authorizing certain licensed charitable organizations located in certain counties to increase the value of certain prizes PURPOSE : Authorizes certain charitable organizations, licensed to conduct games which are located within a fifty mile radius of the Indian gaming operation, to increase the value of the prizes. SUMMARY OF PROVISIONS : Subdivision 1 of section 435 of the executive law is amended by adding a new paragraph J, section 479 of the general municipal law is amended by adding a new subdivision 11, The benevolent orders law is amended by adding a new section 3-b, the not-for-profit corporation law is amended by adding a new section 116. JUSTIFICATION : This bill better allows charitable organizations to compete with local Indian gaming operations by increasing the value of their prizes more to the level of Indian gaming operations. NOZZOLIO -- read twice and ordered printed, and when printed to be committed to the Committee on Racing, Gaming and Wager- ing AN ACT to amend the executive law, the general municipal law, the benev- olent orders law, and the not-for-profit corporation law, in relation to authorizing certain licensed charitable organizations located in certain counties to increase the value of certain prizes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 1 of section 435 of the executive law is amended by adding a new paragraph (j) to read as follows: (J) AUTHORIZE CERTAIN CHARITABLE ORGANIZATIONS, LICENSED TO CONDUCT GAMES UNDER THIS ARTICLE WHICH ARE LOCATED WITHIN A FIFTY MILE RADIUS OF THE INDIAN GAMING OPERATION, TO INCREASE THE VALUE OF THE PRIZES. S 2. Section 479 of the general municipal law is amended by adding a new subdivision 11 to read as follows: 11. NOTWITHSTANDING ANY PROVISION OF THIS CHAPTER TO THE CONTRARY, ANY CHARITABLE ORGANIZATION LICENSED UNDER THE PROVISIONS OF THIS ARTICLE SHALL BE AUTHORIZED TO INCREASE THE AMOUNT OF THE PRIZES OFFERED IF SUCH ORGANIZATION IS LOCATED WITHIN A FIFTY MILE RADIUS OF THE INDIAN GAMING OPERATION. S 3. The benevolent orders law is amended by adding a new section 3-b to read as follows: S 3-B. POWER TO INCREASE PRIZE AMOUNTS. ANY ORGANIZATION PURSUANT TO SECTION THREE OF THIS ARTICLE WHICH IS LOCATED WITHIN A FIFTY MILE RADI- US OF AN OPERATION WHICH AUTHORIZES INDIAN GAMING, AND WHERE SUCH ORGAN- IZATION CONDUCTS CERTAIN GAMES LICENSED PURSUANT TO ARTICLE FOURTEEN-H OF THE GENERAL MUNICIPAL LAW, SHALL BE AUTHORIZED TO INCREASE THE AMOUNT OF THE PRIZES FOR SUCH GAMES OF CHANCE OR BINGO. S 4. The not-for-profit corporation law is amended by adding a new section 116 to read as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
