BILL NUMBER: S5034 TITLE OF BILL : An act to amend the social services law, in relation to limiting co-payments for child care funded by block grants to ten percent of household income PURPOSE OR GENERAL IDEA OF BILL : This bill limits family co-payments for child care funded through block grants to ten percent of household income. SUMMARY OF SPECIFIC PROVISIONS : Section one amends social services law subdivision 6 to provide a child care assistance on a sliding fee basis based upon the family's ability to pay. Co-payments shall not exceed ten percent of a family's household income. JUSTIFICATION : A child care subsidy provides low income parents access to quality child care that they could not otherwise afford, but it only provides meaningful access if the parents' co-payments are in an amount that low income families can afford. A cap equal to 10% of household income would assure that New York complies with the intent of the federal child care legislation that co-payments be affordable and provide equitable treatment of similarly situated low-income families across the state. HASSELL-THOMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Children and Families AN ACT to amend the social services law, in relation to limiting co-pay- ments for child care funded by block grants to ten percent of house- hold income THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 410-x of the social services law, as added by section 52 of part B of chapter 436 of the laws of 1997, is amended to read as follows: 6. Pursuant to department regulations, child care assistance shall be provided on a sliding fee basis based upon the family's ability to pay. CO-PAYMENTS SHALL NOT EXCEED TEN PERCENT OF A FAMILY'S HOUSEHOLD INCOME. S 2. This act shall take effect on the one hundred eightieth day after it shall have become a law. Effective immediately the commissioner of children and family services is authorized to promulgate any and all rules and regulations and take any other measures necessary to implement this act on its effective date on or before such date.
