Authorizes the New York state 911 board to adopt standards governing reasonable eligible wireless 911 service costs for funding of enhanced wireless 911 service; authorizes the New York state 911 board to develop a regional pilot program for expedited deployment in two counties which is based upon technology using a call associated signaling system which utilizes voice over Internet protocol.

BILL NUMBER: S5081 TITLE OF BILL : An act to amend the county law, in relation to the creation of a regional pilot program for enhanced wireless 911 service based on voice over internet protocol technology PURPOSE : This bill would establish a regional pilot program for a digitally-based wireless emergency communication system. SUMMARY OF SPECIFIC PROVISIONS : Section 1 amends paragraph (f) of subdivision 5 of section 309 of the county law to make an appropriation of $15 million for 2009-2010. Section 2 adds a new subdivision 5-a of section 328 of the county law that calls for the state 911 board to adopt standards governing the regional pilot program. The board shall consider whether the projected costs are reasonably necessary for the provision of enhanced wireless 911 service and whether the priority enhanced wireless plan conforms to the FCC order. Section 3 amends subdivision 9 of section 328 of the county law. It requires the state 911 board's annual report to include information relating to the regional pilot program. The information regarding the program shall include but not be limited to, the number of grant awards made for the program, dollar value of the grant awards, and the status of implementation of the programs funded by the regional pilot

LEIBELL -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the county law, in relation to the creation of a regional pilot program for enhanced wireless 911 service based on voice over internet protocol technology THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 328 of the county law is amended by adding a new subdivision 5-a to read as follows: 5-A. THE BOARD SHALL ADOPT STANDARDS GOVERNING REASONABLE ELIGIBLE WIRELESS 911 SERVICE COSTS FOR FUNDING OF ENHANCED WIRELESS 911 SERVICE, REPAYMENT PROVISIONS, AND THE CRITERIA FOR APPROVAL OF PRIORITY ENHANCED WIRELESS 911 PLANS FOR THE REGIONAL PILOT PROGRAM ESTABLISHED PURSUANT TO SUBDIVISION SEVEN OF SECTION THREE HUNDRED THIRTY-THREE OF THIS ARTI- CLE. STANDARDS FOR THE REGIONAL PILOT PROGRAM SHALL CONSIDER WHETHER THE PROJECTED COSTS ARE REASONABLY NECESSARY FOR THE PROVISION OF ENHANCED WIRELESS 911 SERVICE AND WHETHER THE PRIORITY ENHANCED WIRELESS PLAN CONFORMS TO THE FCC ORDER. S 2. Subdivision 9 of section 328 of the county law, as added by section 1 of part G of chapter 81 of the laws of 2002 and as renumbered by chapter 292 of the laws of 2004, is amended to read as follows: 9. The board shall issue an annual report to the governor, the tempo- rary president of the senate, the minority leader of the senate, the speaker of the assembly, and the minority leader of the assembly, on or before March first of each year, regarding the board's activities in the previous calendar year, including but not limited to, the status of 911 services across the state, including the extent to which public safety answering points across the state are equipped to receive enhanced wire- less 911 calls, the allocation of moneys from the fund including allo- cations made and not disbursed, and the disbursements of moneys from the fund. THE REPORT SHALL ALSO INCLUDE INFORMATION RELATING TO THE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11289-01-9
