BILL NUMBER: S5101
TITLE OF BILL :
An act to amend the education law, in relation to service credit in
the New York state teachers' retirement system
SUMMARY OF PROVISIONS :
This bill adds a new subdivision 12 to Section 509 of the Education
Law to permit members of the New York State Teachers' Retirement
System to receive service credit for up to 90 days of unused
accumulated sick leave adding to their credit at the time of their
retirement The members would be specifically prohibited from using the
additional credit for purposes of qualifying for retirement or for
calculation of final average salary.
JUSTIFICATION :
This bill would extend to teachers who are members of the New York
State Teachers' Retirement System a benefit similar to that currently
enjoyed by members of the New York State Employees' Retirement System.
Specifically, it would allow teachers, at the time of their retirement
for service, to obtain additional credit for unused sick leave days up
to a maximum of 90 such days. This additional credit would be helpful
in giving the teachers more service credit to be used in the
calculation of their pension benefits, but would not be used in the
calculation of their final average salary, upon which benefits are

AN ACT to amend the education law, in relation to service credit in the
New York state teachers' retirement system
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 509 of the education law is amended by adding a new
subdivision 13 to read as follows:
13. IN ADDITION TO ANY OTHER SERVICE CREDIT TO WHICH HE OR SHE IS
ENTITLED, A MEMBER, SUBJECT TO THIS ARTICLE OR TO ARTICLE FOURTEEN OR
FIFTEEN OF THE RETIREMENT AND SOCIAL SECURITY LAW, WHO RETIRES ON OR
AFTER JULY FIRST, TWO THOUSAND TEN AND WHO, PRIOR TO RETIREMENT, WAS
SUBJECT TO A PLAN ESTABLISHED BY AN EMPLOYER BY LAW, RULE, REGULATION,
WRITTEN ORDER OR WRITTEN POLICY WHICH PROVIDED FOR THE REGULAR EARNING
AND ACCUMULATION OF SICK LEAVE SHALL BE GRANTED ONE DAY OF ADDITIONAL
SERVICE CREDIT FOR EACH DAY OF ACCUMULATED UNUSED SICK LEAVE WHICH HE OR
SHE HAS AT TIME OF RETIREMENT FOR SERVICE, BUT SUCH CREDIT SHALL NOT (A)
EXCEED NINETY DAYS, (B) BE CONSIDERED IN MEETING ANY SERVICE OR AGE
REQUIREMENTS PRESCRIBED IN THIS ARTICLE, OR (C) BE CONSIDERED IN COMPUT-
ING FINAL AVERAGE SALARY.
S 2. This act shall take effect immediately.
