BILL NUMBER: S5142 TITLE OF BILL : An act to amend chapter 654 of the laws of 1927 relating to joint water works systems, in relation to the composition of and compensation paid to the board of trustees SUMMARY OF PROVISIONS : Section 1 amends Subdivision 2 of Section 3 of chapter 654 of the laws of 1927, increasing the number of trustees from one per municipality, to three, composed of a municipality's chief executive officer and two community members. Section 2 amends Subdivision 7 of Section 3 of chapter 654 of the laws of 1927, to increase the limit for trustee compensation from up to $10 per meeting to $100 per meeting JUSTIFICATION : In the case of a board of trustees made up of solely the chief executive of a municipality, a two municipality board, such as seen with the villages of Sandy Creek and Lacona in Oswego County, if there is a disagreement it creates a deadlock. By including two additional members of each municipality, it makes the process more transparent with two community members and reduces the likelihood of a voting deadlock.

AUBERTINE -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend chapter 654 of the laws of 1927 relating to joint water works systems, in relation to the composition of and compensation paid to the board of trustees THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 3 of chapter 654 of the laws of 1927 relating to joint water works systems, is amended to read as follows: 2. [Each municipality, thus conferring, shall be entitled to one vote, which shall be cast through its representative.] THE BOARD OF TRUSTEES SHALL HAVE A MINIMUM OF SIX MEMBERS, CONSISTING OF TWO RESIDENT VOTERS OF EACH MUNICIPALITY AND THE CHIEF EXECUTIVE OFFICER OF EACH MUNICI- PALITY. EACH MEMBER OF THE BOARD OF TRUSTEES SHALL BE ENTITLED TO ONE VOTE. Whenever the representatives of such municipalities, shall thus meet and confer, they shall choose a temporary chairman and a temporary clerk, whose duty it shall be to keep the minutes of the proceedings. The meetings may be adjourned from time to time, but any two or more of such municipalities, thus meeting and conferring, may at any time through their representatives, adopt a proposition to acquire, construct or provide a joint water works system, or acquire a supply of water for the purposes herein defined, and they shall adopt a name for said joint water works system, which name shall include the words "joint water works". S 2. Subdivision 7 of section 3 of chapter 654 of the laws of 1927 relating to joint water works systems, as amended by chapter 232 of the laws of 2006, is amended to read as follows: 7. Each member of the board of trustees shall be entitled to receive [the sum of ten] UP TO ONE HUNDRED dollars as compensation for his attendance at each meeting of the board of trustees except that each EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
