BILL NUMBER: S5150 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to the suspension and disqualification of drivers licenses for failure to make child support payments PURPOSE : To include the word "RESTRICTED" in bold face type on a restricted driver's license granted to a person whose license has been suspended for failure to make child support payments. SUMMARY OF PROVISIONS : Paragraph 5 of subdivision 4-e of section 510 of the vehicle and traffic law, as amended by chapter 398 of the laws of 1997 is amended. JUSTIFICATION : This bill would help to identify a situation where a person who has failed to make child support payments uses a restricted license. Previously, the person was restricted to drive to and from work, school, and medical and the person was issued a sheet of paper that he or she is relied on to present to an officer upon being pulled over. This bill would help to identify these "restricted" drivers to determine if they ate breaking any laws. Also, this bill would require that if a restricted license is granted, and the commissioner is notified of a person's failure to satisfy support arrears, the commissioner shall revoke any restricted use license granted. MORAHAN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the suspen- sion and disqualification of drivers licenses for failure to make child support payments THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph 5 of subdivision 4-e of section 510 of the vehi- cle and traffic law, as amended by chapter 601 of the laws of 2007, is amended to read as follows: (5) Any person whose license has been suspended pursuant to subdivi- sion three of this section may apply for the issuance of a restricted use license as provided in section five hundred thirty of this title. THE COMMISSIONER SHALL ESTABLISH BY REGULATION THAT ANY RESTRICTED LICENSE GRANTED TO A PERSON WHOSE LICENSE HAS BEEN SUSPENDED PURSUANT TO SUBDIVISION THREE OF THIS SECTION SHALL INCLUDE THE WORD "RESTRICTED" IN BOLD FACE TYPE. IF A RESTRICTED USE LICENSE IS GRANTED AND THE DEPART- MENT RECEIVES NOTIFICATION FROM THE OFFICE OF TEMPORARY AND DISABILITY ASSISTANCE OF SUCH PERSON'S FAILURE TO SATISFY SUPPORT ARREARS, THE COMMISSIONER OR HIS OR HER AGENT SHALL REVOKE ANY RESTRICTED USE LICENSE GRANTED. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law. Effective immediately, the addition, amend- ment and/or repeal of any rule or regulation necessary for the implemen- tation of this act on its effective date is authorized and directed to be made and completed on or before such effective date; provided further, however, that the amendments to subdivision 4-e of section 510 of the vehicle and traffic law made by section one of this act shall not affect the repeal of such subdivision and shall be deemed repealed ther- ewith.
