BILL NUMBER: S5245 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to animals at large PURPOSE : Amends the agriculture and markets law, to allow animals to run free on public or private property without the property owner's permission. SUMMARY OF PROVISIONS : Section 1: amends agriculture and markets law to make it unlawful for any animal owner, either willfully or through negligence to allow his or her animals to run at large on public property, unless such public property expressly authorizes such action, or upon the private property of others. EXISTING LAW : Section 373 of the Agriculture and Markets law allows animals who are lost, abandoned or strayed to be picked up by authorities if they are found on public property. However, there are no provisions in the law to make it unlawful to allow your animal to wander. JUSTIFICATION : Currently, many localities across the nation have issued ordinances to regulate nuisance animals. This bill would establish a statewide policy on how to address complaints by a neighbor of another's animals being allowed to wander on to his or her property by creating a legal responsibility to control one's pets.

ALESI -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to animals at large THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The agriculture and markets law is amended by adding a new section 380 to read as follows: S 380. ANIMALS AT LARGE. IT SHALL BE UNLAWFUL FOR ANY ANIMAL OWNER, EITHER WILLFULLY OR THROUGH FAILURE TO EXERCISE DUE CARE AND CONTROL, TO ALLOW HIS OR HER ANIMAL OR ANIMALS TO RUN AT LARGE UPON PUBLIC PROPERTY, UNLESS SUCH PUBLIC PROPERTY EXPRESSLY AUTHORIZES SUCH ACTION, OR UPON PRIVATE PROPERTY OF OTHERS, INCLUDING, BUT NOT LIMITED TO, COMMON AREAS OF CONDOMINIUMS, CLUSTER HOMES, PLANNED UNIT DEVELOPMENTS AND COMMUNITY ASSOCIATIONS WITHOUT THE CONSENT OF ALL OWNERS THEREOF, UNLESS SUCH PRIVATE PROPERTY OWNERS AUTHORIZE SUCH ACTION BY EXPRESS OR IMPLIED CONSENT. S 2. This act shall take effect on the one hundred twentieth day after it shall have become a law.
