BILL NUMBER: S5249 TITLE OF BILL : An act to amend the public health law, in relation to determining eligibility for the child health plus program, the medical assistance program and the family health plus program PURPOSE : This bill allows the consolidation of the three call centers to take place, while at the same time ensuring that only trained and qualified public employees are used when making continuing and initial eligibility for CHP, FHP, and Medicaid. SUMMARY OF PROVISIONS : This bill would ensure that only qualified and well-trained public employees are making eligibility determinations for these public health insurance programs. JUSTIFICATION : The Department of Health (DOH) currently has three separate call centers that disseminate information regarding Family Health Plus (FHP), Child Health Plus (CHP), and Medicaid. The call-centers for FHP and Medicaid are staffed by DOH employees and are located within New York State. The call center for CRP has been contracted out to a third-party that uses private employees and is located in Pittsburgh, Pennsylvania. The 2008-09 State budget gave DOH authorization to issue a request for proposals (RFP) which would require the winning bidder to consolidate the three call centers into one, develop a statewide telephone and

ABBATE -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to determining eligi- bility for the child health plus program, the medical assistance program and the family health plus program THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 24 of section 206 of the public health law, as amended by section 69 of part C of chapter 58 of the laws of 2009, is amended to read as follows: 24. Notwithstanding any inconsistent provision of law to the contrary, the commissioner is authorized to receive applications and to determine initial and continuing eligibility for enrollment under the child health plus program established under title I-A of article twenty-five of this chapter, the medical assistance program established under title eleven of article five of the social services law, and the family health plus program established under title eleven-D of such article. The commis- sioner may exercise such authority with respect to all residents, or a subset of residents, of one or more local social services districts. The commissioner is authorized to enter into one or more contracts, which contracts shall be procured on a competitive basis pursuant to a request for proposal process, for the purpose of exercising his or her authority under this subdivision. State employees shall supervise and provide oversight and quality assurance monitoring of contract staff activities. Provided further, the department shall [endeavor to] use state employees in exercising the commissioner's authority under this subdivision. S 2. This act shall take effect immediately.
