AN ACT to authorize the department of transportation to conduct a study
of the feasibility and impact of requiring commercial motor vehicles
to be equipped with back-up sound warning devices and to prepare a
report concerning its findings
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The department of transportation shall conduct a study to
determine the feasibility of requiring commercial vehicles sold in and
licensed to travel on the public roads of this state be fitted with
apparatus or technology that emits a sound when the vehicle is placed in
reverse gear and to establish a sound standard applicable to such appa-
ratus or technology. The sound required should vary in such a way that
it is noticeably different from other sounds emitted by a vehicle when
the vehicle is engaged in other operations, including idling, accelerat-
ing or decelerating. In conducting the study, the department of trans-
portation shall review all available research and literature regarding
the use of such equipment and the impact of the presence of such equip-
ment on the safety of pedestrians. The study need not prescribe the
apparatus, technology, or method to be used by commercial vehicle
manufacturers to achieve the required sound level. This study shall be
completed within six months following the effective date of these
provisions.
S 2. Upon completion of the study, the commissioner of transportation
or his or her designee shall make a report, such report to be no longer
than five pages, to the governor, the speaker of the assembly, the
temporary president of the senate, the minority leader of the assembly
and the minority leader of the senate of the findings, conclusions and
recommendations arising from the study. This report shall be submitted
no later than sixty days after completion of the study.
S 3. This act shall take effect immediately.
