BILL NUMBER: S5335 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to authorizing organ procurement organizations and/or organ transportation companies to utilize red lights and certain white lights PURPOSE : To authorizing organ procurement organizations and/ or organ transportation companies to utilize red lights and certain white lights to transport organs of human transplantation or to transport the medical personnel for the immediate purposes of performing human organ harvesting, or transportation, and said vehicles are respectively authorized emergency vehicles equipped with sirens. SUMMARY OF PROVISIONS : To authorizing organ procurement organizations and! or organ transportation companies to utilize red lights and certain white lights to transport organs of human transplantation or to transport the medical personnel for the immediate purposes of performing human organ harvesting, or transportation, and said vehicles are respectively authorized emergency vehicles equipped with sirens and the operators of organ transport vehicles shall have successfully completed a safety training course.

MORAHAN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to authorizing organ procurement organizations and/or organ transportation companies to utilize red lights and certain white lights THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph 2 of subdivision 41 of section 375 of the vehicle and traffic law, as added by chapter 197 of the laws of 1970, is amended to read as follows: 2. Red lights and certain white lights. (A) RED AND WHITE LIGHTS MAY BE AFFIXED TO ANY MOTOR VEHICLE OWNED AND DESIGNATED BY AN ORGAN PROCUREMENT ORGANIZATION AND/OR ORGAN TRANSPORTATION COMPANY TO TRANS- PORT ORGANS FOR THE IMMEDIATE PURPOSE OF HUMAN TRANSPLANTATION OR TO TRANSPORT MEDICAL PERSONNEL FOR THE IMMEDIATE PURPOSE OF PERFORMING HUMAN ORGAN HARVESTING OR TRANSPLANTATION, AND SAID VEHICLES ARE RESPEC- TIVELY AUTHORIZED EMERGENCY VEHICLES. THE ORGAN TRANSPORT VEHICLES SHALL BE EQUIPPED WITH SIRENS AND ARE PERMITTED THE SAME TRAFFIC LAW EXEMPTIONS AND SUBJECT TO THE SAME LIMITATIONS AS OTHER AUTHORIZED EMER- GENCY VEHICLES. THE OPERATORS OF ORGAN TRANSPORT VEHICLES SHALL HAVE SUCCESSFULLY COMPLETED, A SAFETY TRAINING COURSE IN EMERGENCY VEHICLE OPERATION AND EACH VEHICLE WILL BE ISSUED A NEW YORK STATE AUTHORIZED EMERGENCY VEHICLE PLACARD IN ORDER FOR TRAFFIC LAW EXEMPTIONS TO APPLY. EACH OPERATOR SHALL REVIEW SAFETY AND TRAINING PROCEDURE ONCE EVERY TWO YEARS. (B) One or more red or combination red and white lights, or one white light which must be a revolving, rotating, flashing, oscillating or constantly moving light, may be affixed to an authorized emergency vehi- cle, and such lights may be displayed on an authorized emergency vehicle when such vehicle is engaged in an emergency operation, and upon a fire vehicle while returning from an alarm of fire or other emergency. S 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
