BILL NUMBER: S5399 TITLE OF BILL : An act in relation to granting Tier 1 status in the New York state and local employees' retirement system to Lynn Levin PURPOSE : Grants Tier 1 status in the New York state and local employees retirement system to Lynn Levin. SUMMARY OF PROVISIONS : Section 1. Allows Lynn Levin to be reinstated to membership with the New York state and local employees retirement system with her original date of membership and tier status. Section 2. Effective date JUSTIFICATION : Lynn Levin was employed by the New York City department of health and mental hygiene from June 29, 1973 until a later date in 1973 and again from March 18, 1974 until a later date in 1974 and for reasons not ascribable to her own negligence, did not enroll in the New York City employees retirement system. Mrs. Levine later enrolled in the New York State and local employees retirement system in 1978. This legislation will allow Mrs. Levine to be reinstated to membership with

FUSCHILLO -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT in relation to granting Tier 1 status in the New York state and local employees' retirement system to Lynn Levin THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, Lynn Levin, who is currently a member of the New York state and local employees' retire- ment system, and who currently is a uniformed senior court officer, but who worked for the New York city department of health and mental hygiene from June 29, 1973 until a later date in 1973 and again from March 18, 1974 until a later date in 1974 and who for reasons not ascribable to her own negligence, did not enroll in the New York city employees' retirement system at such time, and who subsequently enrolled in the New York state and local employees' retirement system in 1978, shall be deemed to have joined the New York state and local employees' retirement system on June 29, 1973 provided she files a written request with the administrative head of the retirement system on or before the thirty- first day of December next succeeding the date on which this act shall become law. S 2. This act shall take effect immediately. FISCAL NOTE.--Pursuant to Legislative Law, section 50: This bill will deem Lynn Levin, a uniformed senior court officer, to have become a member of the New York State and Local Employees' Retire- ment System on June 29, 1973, thereby granting her Tier 1 status. This bill will provide for the return of member contributions to Lynn Levin. If this bill is enacted, we anticipate that there will be an increase of approximately $900 in the annual contributions or the State of New York. In addition to the annual contributions discussed above, there will be a immediate past service cost of approximately $162,000 which will be EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
