  when printed to be committed to the Committee  on  Commerce,  Economic
  Development and Small Business

AN  ACT to amend chapter 519 of the laws of 1999, amending the alcoholic
  beverage control law and the public health law relating to the sale of
  alcohol and tobacco products to minors, in relation to  extending  the
  provisions of such chapter

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 4 of chapter 519 of the laws of 1999  amending  the
alcoholic beverage control law and the public health law relating to the
sale of alcohol and tobacco products to minors, as amended by section 45
of  part  B  of  chapter  58  of the laws of 2009, is amended to read as
follows:
  S 4. This act shall take effect September 1, 1999, AND SHALL REMAIN IN
FULL FORCE AND EFFECT UNTIL JANUARY 1, 2012  WHEN  UPON  SUCH  DATE  THE
PROVISIONS  OF  THIS  ACT SHALL EXPIRE AND BE DEEMED REPEALED; provided,
however, the state liquor authority, state department of motor  vehicles
and  state  department  of health shall promulgate rules and regulations
necessary to implement the provisions of this  act  on  or  before  such
date; PROVIDED FURTHER THAT THE PROVISIONS OF THIS ACT SHALL APPLY AFTER
SUCH  EXPIRATION DATE TO ANY PROCEEDING PURSUANT TO THE ALCOHOLIC BEVER-
AGE CONTROL LAW OR PUBLIC HEALTH LAW TO INVOKE OR ENFORCE THE PROVISIONS
OF THIS ACT WHICH WERE COMMENCED PRIOR  TO  SUCH  EXPIRATION  DATE;  and
provided,  further  however,  that the amendments to section 65-b of the
alcoholic beverage control law made by section two of this act shall not
affect the repeal of such section and shall be  deemed  repealed  there-
with.
  S 2. This act shall take effect immediately.
