AN ACT in relation to allowing certain undersheriffs in the county of
Chemung to join the special retirement plan for sheriffs, undersher-
iffs and deputy sheriffs
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Notwithstanding any other provision of law, Michael Skrosk-
nik, E. Scott Smith, Joseph Dieterle, Richard Mathews, Kasey Slater,
Ryan Wheeler, James Ritter and John M. Allen, who are each employed as a
deputy sheriff in the county of Chemung, and who, are each a member of
the New York state and local employees' retirement system, and who, were
each eligible to make the election pursuant to section 551 of the
retirement and social security law to join the special retirement plan
for sheriffs, undersheriffs and deputy sheriffs engaged in law enforce-
ment activities, but who, for reasons not ascribable to their own indi-
vidual negligence, failed to make such election to join such special
retirement plan, shall each be eligible to individually join such
special retirement plan if on or before December 31, 2009 he or she
files a written request with the state comptroller to that effect.
S 2. All costs incurred by the implementation of this act shall be
borne by the county of Chemung.
S 3. This act shall take effect immediately.
FISCAL NOTE.--Pursuant to Legislative Law, Section 50: This bill will
authorize Chemung County to reopen the provisions of Section 551 of the
Retirement and Social Security Law for deputy sheriffs Michael Skrosk-
nik, E. Scott Smith, Joseph Dieterle, Richard Mathews, Kasey Slater,

Ryan Wheeler, James Ritter, and John M. Allen who are currently not
covered by that Section.
If this bill is enacted, we anticipate that there would be an esti-
mated increase in the annual contributions of Chemung County of approxi-
mately $1,200 for the fiscal year ending March 31, 2010.
In addition to the annual contributions discussed above, there will be
an immediate past service cost of approximately $4,200 which will be
borne by Chemung County, assuming a payment date of February 1, 2010.
This estimate, dated June 18, 2009 and intended for use only during
the 2009 Legislative Session, is Fiscal Note No. 2009-275, prepared by
the Actuary for the New York State and Local Employees' Retirement
System.
