BILL NUMBER: S5949 TITLE OF BILL : An act to authorize the establishment of a housing and community court in the town of Brookhaven PURPOSE : To allow the town board of Brookhaven Town to establish a housing and community court to dispose of all violations of Brookhaven housing laws, codes and ordinances. SUMMARY OF PROVISIONS : Section 1 authorizes the town board of Brookhaven town to establish a housing and community court aimed at assisting the district court in disposing of all violations of Brookhaven housing laws, codes, and ordinances. Further states that the court shall be authorized to render a final decision, determination or order imposing civil penalties. This section also requires the court to substantially comply with article three of the state administrative procedure act. This section also states that the court shall not impose a term of imprisonment or order the arrest or detention of any person. Section 2 is the effective date. FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to authorize the establishment of a housing and community court in the town of Brookhaven THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The town board of the town of Brookhaven may by ordinance or local law establish a housing and community court to assist the district court in the disposition of all violations of town of Brookha- ven housing laws, codes and ordinances. Such court shall be authorized to render a final decision, determination or order imposing civil penal- ties and may take any other action authorized by law. All hearings in the Brookhaven housing and community court shall substantially comply with the requirements of article three of the state administrative procedure act. The court shall not impose a term of imprisonment upon any person or order the arrest or detention of any person. S 2. This act shall take effect immediately.
