BILL NUMBER: S5962 TITLE OF BILL : An act to amend the penal law, in relation to firearms; and to repeal section 15 of chapter 635 of the laws of 1999, enacting the clinic access and anti-stalking act, in relation to stalking PURPOSE : This bill would add certain crimes to the definition of "serious offense" so as to preclude possession of long guns by persons convicted of those offenses. SUMMARY OF PROVISIONS : Section 1 of the bill amends the definition of "serious offense" in Penal Law §265.00(17) to add the offenses of Menacing in the Second Degree and an attempt to commit another serious offense. Section 2 of the bill is a purely technical correction to harmonize amendments to the same provision that is the subject of this departmental bill. That provision, Penal Law §265.00(17), had been amended by a law with two different sections that were substantively the same but different in word order (L.1999, ch. 635, §§ 11, 15), and

SCHNEIDERMAN -- (at request of the Division of State Police) -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the penal law, in relation to firearms; and to repeal section 15 of chapter 635 of the laws of 1999, enacting the clinic access and anti-stalking act, in relation to stalking THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 17 of section 265.00 of the penal law, as amended by section 11 of chapter 635 of the laws of 1999, is amended to read as follows: (b) any of the following offenses defined in the penal law OR ATTEMPTS AT ANY OF THE FOLLOWING OFFENSES: illegally using, carrying or possess- ing a pistol or other dangerous weapon; MENACING IN THE SECOND DEGREE; possession of burglar's tools; criminal possession of stolen property in the third degree; escape in the third degree; jostling; fraudulent accosting; that kind of loitering defined in subdivision three of section 240.35; endangering the welfare of a child; the offenses defined in article two hundred thirty-five; issuing abortional articles; permit- ting prostitution; promoting prostitution in the third degree; stalking in the fourth degree; stalking in the third degree; the offenses defined in article one hundred thirty; the offenses defined in article two hundred twenty. S 2. Section 15 of chapter 635 of the laws of 1999, enacting the clin- ic access and anti-stalking act, is REPEALED. S 3.
