BILL NUMBER: S5986 TITLE OF BILL : An act to amend the education law, in relation to requiring all teachers to complete training in the area of autism and directing the commissioner of education to assure that such training is included in all teacher certification programs PURPOSE OR GENERAL IDEA OF BILL : The purpose of this bill is to require all teachers to receive autism training, not only those who are seeking special education certification. SUMMARY OF SPECIFIC PROVISIONS : Section 1: This bill removes all references to "special education" from subdivision 4 of section 3004 of the education law, leaving the requirement for autism training applicable to all teachers seeking certification. JUSTIFICATION : Approximately 1 out of 150 children has an autistic spectrum disorder. These children are often undiagnosed/under diagnosed. Teachers lack the appropriate training to assist with early identification and intervention. The training curriculums already exist, yet they are optional and not often utilized. This bill makes this very important training mandatory for all teachers seeking certification.

STACHOWSKI -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the education law, in relation to requiring all teachers to complete training in the area of autism and directing the commis- sioner of education to assure that such training is included in all teacher certification programs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 4 of section 3004 of the education law, as amended by chapter 484 of the laws of 2008, is amended to read as follows: 4. a. The commissioner shall prescribe regulations requiring that all persons applying on or after September second, two thousand [nine] ELEV- EN for a teaching certificate or license as a [special education] teach- er for the purposes pursuant to article eighty-nine of this chapter shall, in addition to all the other certification or licensing require- ments, have completed enhanced course work or training in area of chil- dren with autism. In addition, such regulations shall require that enhanced training in the needs of autistic children be provided to each certified school administrator or supervisor assigned on or after September second, two thousand nine to serve as a special education administrator. Such training shall be provided prior to, or as soon as practicable following, assignment as a special education administrator. Individuals serving as special education administrators as of September second, two thousand nine shall complete such training by such date. The enhanced course work or training shall be obtained from an institution or provider which has been approved by the department to provide such course work or training in the needs of autistic children, provided that enhanced training for certified school administrators or supervisors that meets standards prescribed by the commissioner may be included in EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
