  when printed to be committed to the Committee  on  Veterans,  Homeland
  Security and Military Affairs

AN  ACT  to  amend  the  executive law, in relation to the regulation of
  security services on the waters of New York state

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.   The executive law is amended by adding a new section 716
to read as follows:
  S 716. WATERS OF NEW YORK STATE; PRIVATE SECURITY SERVICES.  IN  ADDI-
TION TO THE TRAINING REQUIREMENTS FOR SECURITY GUARDS SET FORTH IN ARTI-
CLE  SEVEN-A  OF  THE  GENERAL  BUSINESS  LAW, NO PRIVATE SECURITY GUARD
COMPANY OR SERVICE SHALL BE EMPLOYED TO PROVIDE SECURITY SERVICES ON THE
WATERS OF NEW YORK STATE UNLESS SUCH PRIVATE SECURITY GUARD  COMPANY  OR
SERVICE  HAS  BEEN  APPROVED  TO  PROVIDE SUCH SERVICES BY THE OFFICE OF
HOMELAND SECURITY. SUCH APPROVAL SHALL BE MADE  UPON  APPLICATION  BY  A
PRIVATE  SECURITY  GUARD  COMPANY OR SERVICE TO THE OFFICE IN THE MANNER
AND FORM DIRECTED BY THE OFFICE. APPROVAL BY THE OFFICE SHALL  BE  BASED
UPON  CRITERIA  DETERMINED  BY  THE OFFICE TO BE NECESSARY TO ENSURE THE
EFFECTIVE PROVISION OF SECURITY SERVICES ON SUCH WATERS.    APPROVAL  BY
THE  OFFICE SHALL BE EVIDENCED BY THE ISSUANCE OF A PERMIT BY THE OFFICE
TO THE PRIVATE SECURITY GUARD COMPANY OR SERVICE. SUCH PERMIT  SHALL  BE
RENEWABLE  EVERY  TWO  YEARS.  THE  FEE  FOR SUCH PERMIT AND ANY RENEWAL
PERMIT SHALL BE FIVE HUNDRED DOLLARS. A RENEWAL PERMIT SHALL  BE  ISSUED
ONLY  IF SUCH PRIVATE SECURITY GUARD COMPANY OR SERVICE MEETS THE CRITE-
RIA REQUIRED TO BE MET FOR THE ISSUANCE OF THE INITIAL PERMIT.
  S 2. This act shall take effect immediately.
