BILL NUMBER: S6044 TITLE OF BILL : An act to legalize, validate, ratify and confirm a transportation contract of the Perry central school district PURPOSE : Provides for state aid for a certain transportation contract of the Perry Central School District. JUSTIFICATION : As a result of a recent audit of student transportation contracts for the 2007-08 school year, it was determined that the Perry Central School District neglected to put out to bid the contract to transport a special needs student to his program at the League for the Handicapped in Springville, New York. Contract C260303 was submitted to the State Education Department without having been bid. The State Education Department rejected the contract between the parent and the school district because it was not competitively bid or awarded through a request for proposals. The expenses associated with the rejected contract are $3,600 and the district estimates the loss in state aid to be $3,200. This legislation will validate the contract

VOLKER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to legalize, validate, ratify and confirm a transportation contract of the Perry central school district THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. All the acts done and proceedings heretofore had and taken or caused to be had and taken by the Perry central school district and by all officers, employees or agents of such school district relating to or in connection with transportation contract C260303 of the 2007-2008 school year with various contractors, and all acts incidental thereto are hereby legalized, validated, ratified and confirmed, notwithstanding any failure to comply with the contract award, approvals and filing provisions of the education law, general municipal law or any other law or any other statutory authority, rule or regulation, other than those filing provisions defined in paragraph a of subdivision 5 of section 3604 of the education law, in relation to any omission, error, defect, irregularity or illegality in such proceeding had and taken. S 2. The education department is hereby directed to consider the aforementioned contract for transportation aid as a valid and proper obligation of the Perry central school district. S 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11957-01-9
