BILL NUMBER: S6078 TITLE OF BILL : An act in relation to granting Leonard Wayne Bourne tier 2 status in the New York state and local employees' retirement system PURPOSE : To grant Leonard Wayne Bourne retroactive membership with Tier II status in the New York State and local retirement system. SUMMARY OF PROVISIONS : EXISTING LAW : None. JUSTIFICATION : Leonard Wayne Bourne started his employment with the Suffolk County Department of Labor in May of 1976, as part of the CETA 6 program. He then became employed with the Public Administration Office within the Suffolk County Department of Labor. Subsequently, Mr. Bourne gained employment in Suffolk County's Social Services division and then left that post for a period of three years. Mr. Bourne again became employed with Suffolk County Department of Social Services in 1984 and remains employed at present. Although the New York State Retirement

LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT in relation to granting Leonard Wayne Bourne tier 2 status in the New York state and local employees' retirement system THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law, Leonard Wayne Bourne, who was employed by the Suffolk county department of labor for the period beginning May 3, 1976 and ending December 19, 1977, and who was employed as a public administrator by the Suffolk county department of labor for the period beginning December 22, 1977 and ending September 30, 1980, and who was employed by the Suffolk county department of social services for the period March 30, 1981 and ending July 9, 1981, and who has been employed with the Suffolk county department of social services since July 9, 1984, and who joined the New York state and local employees' retirement system on March 30, 1981 with tier 3 status, and who, for reasons not ascribable to his own negligence did not join such retirement system on March 30, 1976, shall be deemed to have joined such retirement system on March 30, 1976 with tier 2 status, if, on or before December 31, 2009, he shall file a written request with the state comp- troller to that effect. S 2. All past service costs associated with the implementation of this act shall be borne by the state of New York. S 3. This act shall take effect immediately. FISCAL NOTE.--Pursuant to Legislative Law, Section 50: This bill would grant Leonard Wayne Bourne Tier 2 status in the New York State and Local Employees' Retirement System by changing his date of membership to March 30, 1976. If this bill is enacted, we anticipate that there will be an increase of approximately $1,350 in the annual contributions of Suffolk County.
