                                 BILL NUMBER:  S6133

 TITLE OF BILL :
An act to amend the vehicle and traffic law, in relation to the
issuance of distinctive plates for veterans of the armed forces of the
United States

 PURPOSE :
To create distinctive license plates for the branches of the United
States military and related bodies.

 SUMMARY OF PROVISIONS :
Section 1. Amends the vehicle and traffic law by adding a new section
404-x. 1. Allows for any veteran of the army, navy, air force, marine
corps, coast guard or merchant marine of the United States shall, upon
request, be issued a distinctive license plate for the body they
belonged to.

2. States that plates will only be issued upon proof of one's veteran
status or the spouse of such veteran.

3. States that shall be issued in similar fashion to other distinctive
plates and authorizes that an additional one time service charge of
ten dollars shall be charged for such plate.

4. States that no special number plates shall be issued unless the

commissioner feels the amount of annual service charges collected will
be sufficient to recover costs of the design and manufacture of such
special plates.

Section 2. Effective date.

 JUSTIFICATION :
Many New Yorkers serve in the US army, navy, air force, marine corps,
coast guard or merchant marines and some of these New Yorkers are even
serving our nation currently Iraq and Afghanistan. This bill will
allow for the creation of license plates bearing the words "United
States Army Veteran", "United States Navy Veteran", "United States Air
Force Veteran", "United States Marine Corps Veteran", "United States
Coast Guard Veteran", or "United States Merchant Marine Veteran",
respectively. Creating these broader plates will help honor all our
veterans who sacrificed to protect our nation.

 EFFECTIVE DATE :
This act shall take effect on the first of January next succeeding the
date on which it shall have become a law.

AN ACT to amend the vehicle and traffic law, in relation to the issuance
  of distinctive plates for veterans of the armed forces of  the  United
  States

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The vehicle and traffic law is  amended  by  adding  a  new
section 404-x to read as follows:
  S  404-X.  DISTINCTIVE  PLATES FOR VETERANS OF THE ARMED FORCES OF THE
UNITED STATES. 1. ANY VETERAN OF  THE  ARMY,  NAVY,  AIR  FORCE,  MARINE
CORPS, COAST GUARD OR MERCHANT MARINE OF THE UNITED STATES OR THE SPOUSE
OF ANY SUCH VETERAN SHALL, UPON REQUEST, BE ISSUED A LICENSE PLATE BEAR-
ING  THE  WORDS "UNITED STATES ARMY VETERAN", "UNITED STATES NAVY VETER-
AN", "UNITED STATES AIR FORCE  VETERAN",  "UNITED  STATES  MARINE  CORPS
VETERAN", "UNITED STATES COAST GUARD VETERAN" OR "UNITED STATES MERCHANT
MARINE  VETERAN",  RESPECTIVELY.  IF  A DISTINCTIVE PLATE IS ISSUED TO A
VETERAN PURSUANT TO THIS SECTION, SUCH A DISTINCTIVE PLATE SHALL NOT  BE
ISSUED TO THE SPOUSE OF SUCH VETERAN. APPLICATION FOR SUCH LICENSE PLATE
SHALL  BE  FILED  WITH  THE  COMMISSIONER IN SUCH FORM AND DETAIL AS THE
COMMISSIONER SHALL PRESCRIBE.
  2. THE DISTINCTIVE PLATE AUTHORIZED IN SUBDIVISION ONE OF THIS SECTION
SHALL BE ISSUED UPON PROOF, SATISFACTORY TO THE COMMISSIONER,  THAT  THE
APPLICANT IS A VETERAN OF THE ARMY, NAVY, AIR FORCE, MARINE CORPS, COAST
GUARD  OR  MERCHANT  MARINE  OF THE UNITED STATES, OR THE SPOUSE OF SUCH
VETERAN.
  3. A DISTINCTIVE PLATE ISSUED PURSUANT TO THIS SECTION SHALL BE ISSUED
IN THE SAME MANNER AS OTHER NUMBER PLATES UPON PAYMENT  OF  THE  REGULAR
REGISTRATION  FEE PRESCRIBED BY SECTION FOUR HUNDRED ONE OF THIS ARTICLE
PROVIDED, HOWEVER, THAT AN ADDITIONAL ONE TIME  SERVICE  CHARGE  OF  TEN
DOLLARS SHALL BE CHARGED FOR SUCH PLATE.

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                      [ ] is old law to be omitted.

  4.  NOTHING  CONTAINED IN THIS SECTION SHALL REQUIRE THE ISSUANCE OF A
SPECIAL NUMBER PLATE UNDER  THIS  SECTION  UNLESS  THE  COMMISSIONER  IS
SATISFIED  THAT THE AGGREGATE AMOUNT OF ANNUAL SERVICE CHARGES COLLECTED
PURSUANT TO SUBDIVISION THREE OF THIS  SECTION  WILL  BE  SUFFICIENT  TO
RECOVER THE COSTS OF THE DESIGN AND MANUFACTURE OF SUCH SPECIAL PLATES.
  S  2. This act shall take effect on the first of January next succeed-
ing the date on which it shall have become a law.
