  printed to be committed to the Committee on Rules

AN  ACT  to  amend  the  environmental  conservation law, in relation to
  exempting active duty military personnel from taking required  hunting
  courses for purposes of obtaining a hunting license

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subparagraph 3 of paragraph a of subdivision 3  of  section
11-0713  of the environmental conservation law, as amended by section 27
of part F of chapter 82 of the laws  of  2002,  is  amended  and  a  new
subparagraph 4 is added to read as follows:
  (3) a certificate of qualification in responsible hunting, responsible
bowhunting  and responsible trapping practices, including safety, ethics
and landowner-hunter relations, issued or  honored  by  the  department,
pursuant to this subdivision[.]; OR
  (4)  PROOF  OF  MEMBERSHIP  IN  THE  MILITARY  FORCES  AND  ENGAGED IN
FULL-TIME ACTIVE MILITARY DUTY OR ACTIVE MILITARY SERVICE OF THE  UNITED
STATES BY A RESIDENT OF THE STATE. FOR PURPOSES OF THIS PARAGRAPH:
  (A) "ACTIVE MILITARY DUTY" SHALL MEAN MILITARY DUTY IN OR WITH A FORCE
OF  THE ORGANIZED MILITIA (NOT INCLUDING THE INACTIVE NATIONAL GUARD AND
NOT INCLUDING THE NEW YORK GUARD WHEN IN AN INACTIVE STATUS) OR  IN  THE
DIVISION  OF  MILITARY  AND NAVAL AFFAIRS OF THE EXECUTIVE DEPARTMENT OF
THE STATE; AND
  (B)  "ACTIVE  MILITARY  SERVICE  OF  THE  UNITED  STATES"  SHALL  MEAN
FULL-TIME  DUTY IN THE ARMY, NAVY (INCLUDING MARINE CORPS), AIR FORCE OR
COAST GUARD OF THE UNITED STATES.
  S 2. This act shall take effect immediately.
