BILL NUMBER: S6299
TITLE OF BILL :
An act to amend the alcoholic beverage control law, in relation to the
penalty for the illegal sale of an alcoholic beverage to a visibly
intoxicated person
PURPOSE :
To make the selling of alcoholic beverages to any visibly intoxicated
person by any person acting under the authority of a license or permit
to sell alcoholic beverages for consumption on the premises, a felony.
SUMMARY OF PROVISIONS :
Section one amends section 65 of the Alcoholic Beverage Control Law by
adding a new subdivision 7 that would make the selling of alcoholic
beverages to any visibly intoxicated person by any person acting under
the authority of a license or permit to sell alcoholic beverages for
consumption on the premises, a felony. Section two is the effective
date.

AN ACT to amend the alcoholic beverage control law, in relation to the
penalty for the illegal sale of an alcoholic beverage to a visibly
intoxicated person
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. Section 65 of the alcoholic beverage control law is amended
by adding a new subdivision 7 to read as follows:
7. A VIOLATION OF THE PROVISIONS OF SUBDIVISION TWO OF THIS SECTION BY
ANY PERSON ACTING UNDER THE AUTHORITY OF A LICENSE OR PERMIT TO SELL
ALCOHOLIC BEVERAGES AT RETAIL FOR CONSUMPTION ON THE PREMISES SHALL BE A
FELONY.
S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
