BILL NUMBER: S6362 TITLE OF BILL : An act to amend the general obligations law, in relation to parental liability for damage caused by an infant's commission of the crime of making graffiti PURPOSE : To allow the governing board or local legislative body to pass a local law along parents to be liable for damage caused by their child's graffiti. SUMMARY OF PROVISIONS : Section 1 allows the governing body or local legislative body Legislature to adopt a law establishing parental liability in the event of damages caused by an infant which such individual has been convicted of making graffiti under section 145.60 of the penal law. Section 2 is the effective date. JUSTIFICATION : Juveniles causing graffiti is a pervasive and costly crime for municipalities to deal with. By making parents liable for the costs of cleaning up their child's graffiti we are providing a financial incentive for parents to pay closer attention to the actions of which their children are a part of, while also giving localities an ability

FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the general obligations law, in relation to parental liability for damage caused by an infant's commission of the crime of making graffiti THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3-112 of the general obligations law is amended by adding a new subdivision 5 to read as follows: 5. THE GOVERNING BOARD OR LOCAL LEGISLATIVE BODY OF ANY COUNTY, CITY, TOWN OR VILLAGE MAY, BY ADOPTION OF A LOCAL LAW OR ORDINANCE, PROVIDE FOR A CAUSE OF ACTION IN A CIVIL COURT OF COMPETENT JURISDICTION TO ENFORCE THE LIABILITY IMPOSED BY THIS SECTION IN THE EVENT OF DAMAGES CAUSED BY AN INFANT WHERE SUCH INFANT HAS BEEN CONVICTED OF THE CRIME OF MAKING GRAFFITI PURSUANT TO SECTION 145.60 OF THE PENAL LAW.
