BILL NUMBER: S6618 TITLE OF BILL : An act in relation to granting Christina Paino tier I status in the New York state teachers' retirement system PURPOSE : This legislation would grant Christina Paino retroactive membership in the New York State Teachers' Retirement. SUMMARY OF PROVISIONS : Section 1 grants Christina Paino retroactive membership in the New York State Teachers' Retirement System if she files a request to do so with the head of such system on or before December 31, 2008. Section 2 socializes the costs associated with implementation of this legislation. Section 3 provides that any previous contributions made by Christina Paino shall not be returned to her and to are to be used to offset any past service cost. Section 4 is the effective date of the bill. JUSTIFICATION :

FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Civil Service and Pensions AN ACT in relation to granting Christina Paino tier I status in the New York state teachers' retirement system THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, Christina Paino, who was employed by the Western Suffolk Board of Coop- erative Educational Services, from October 5, 1968 through June 1970, and was employed by the Town of Smithtown Recreation Department during the periods of 1969 through 1976 and from 1980 through 1992, and who, has been employed by the Patchogue-Medford School District from Septem- ber 1985 to the present, and who, for reasons not ascribable to her own negligence, failed to become a member of the New York State Teachers' Retirement System until September 1985, and who previously received service credit for such employment with the Western Suffolk Board of Cooperative Educational Services and the Town of Smithtown Recreation Department, shall be granted retroactive membership in the New York State Teachers' Retirement System effective October 5, 1968, if, on or before December 31, 2010, she shall file a written request with the head of the New York State Teachers' Retirement System to that effect. S 2. All costs associated with this act shall be borne by the employ- ers of members of the New York State Teachers' Retirement System. S 3. Notwithstanding any other provision of law, no employee contrib- utions shall be returned to Christina Paino. Such employee contributions shall be used to offset any past service costs incurred due to enactment of this legislation. S 4. This act shall take effect immediately. FISCAL NOTE.--This bill would allow Christina Paino, a member of the New York State Teachers' Retirement System with Tier 4 status, to be reclassified as a Tier 1 member with all rights, benefits, and privi- leges which would be available to her as a Tier 1 member. Employee contributions made pursuant to Article 15 of the Retirement and Social Security Law would not be refunded to Ms. Paino. Ms. Paino must file a EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
