Provides that photo images of a licensee contained on a renewal license shall be filed for no more than one year from the date of renewal; such provisions shall not apply to any person who is 62 years of age or older when he or she renews his or her license or learner's permit.

AN ACT to amend the vehicle and traffic law, in relation to the  age  of
  driver's license photographs contained on renewal licenses

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph (b) of subdivision 1 of section 504 of the  vehi-
cle  and  traffic law, as amended by chapter 406 of the laws of 2001, is
amended to read as follows:
  (b) The commissioner may by regulation  provide  that  every  driver's
license  contain  the  photo image of the licensee. The learner's permit
may also contain the photo image of  the  permittee  pursuant  to  regu-
lations  established  by  the  commissioner. A PHOTO IMAGE OF A LICENSEE
CONTAINED ON A RENEWAL LICENSE FOR SUCH LICENSEE SHALL HAVE BEEN ON FILE
WITH THE DEPARTMENT FOR NO MORE THAN ONE YEAR PRIOR TO THE DATE ON WHICH
SUCH LICENSE IS RENEWED; PROVIDED, HOWEVER, SUCH REQUIREMENT  SHALL  NOT
APPLY  TO THE PHOTO IMAGE OF ANY PERSON WHO IS SIXTY-TWO YEARS OF AGE OR
OLDER WHEN SUCH PERSON RENEWS HIS OR HER LICENSE OR LEARNER'S PERMIT.
  S 2. This act shall take effect one year after it shall have become  a
law,  and  shall  apply  to  licenses  renewed  on  and after such date;
provided, however, that effective immediately, the  addition,  amendment
and/or repeal of any rule or regulation necessary for the implementation
of this act on its effective date are authorized and directed to be made
and  completed  by  the commissioner of motor vehicles on or before such
effective date.
