 TITLE OF BILL :
An act to create a task force on county public health services to
study and make recommendations on the rules and regulations of the
department of health relating to the development of essential
municipal health services; and providing for the repeal of such
provisions upon expiration thereof


 PURPOSE :
To update Article 6 core and optional services to reflect the changing
realities of counties providing public health in New York State.

 SUMMARY OF PROVISIONS :
Section 1 creates the task force and provides its mandate.

Section 2 outlines the composition of the task force by establishing
the number of appointments (9), who appoints them, their
qualifications, and their geographic representation.

Section 3 states that, other than an allowance for their actual and
necessary expenses, the members will serve without compensation.

Section 4 states that, to the extent feasible, the task force will be
entitled to assistance from the state.

Section 5 mandates that the task force report its findings,
conclusions, and recommendations by the first of January next
succeeding enactment of the bill.

Section 6 states that this act shall take effect immediately and shall
expire on the second of January next succeeding enactment of the bill.

 EXISTING LAW :
This bill proposes study and review of laws and regulations relevant
to county and municipal health services, including public Health Law
Article 6 _ State Aid to Cities and Counties, and New York Codified
Rules and Regulations - Title 10, Subparts 40-2 and 40-3.

 JUSTIFICATION :
Events and circumstances of the recent past as well as current
realities necessitate reconsideration of the services constituting
core and optional services under Article 6 of the Public Health Law.
The task force on county health plans is essential because this
problem requires the participation of experienced individuals
intimately involved with the public health needs of counties and the
manner in which Article 6 core and optional services currently do not
have the sophistication to reflect them.

Article 6 core and optional services must reflect the increased
responsibilities that counties have been forced to accept For example,
the health departments of seventeen counties are the sole providers of
home health care. However, home health care is designated as only an
optional service with the reimbursement levels that accompany optional
services.  Additionally, Article 6 core and optional services need to
be more responsive to immediate county needs as well as the demands
being placed upon them by the federal government, such as bioterrorism
preparedness.  County public health departments have long been
recognized for their seamless coordination of services in time of
disaster, natural or otherwise. To continue to meet the public health
needs of the communities they serve, public health departments must
implement essential services.  A task force on municipal health
departments must be created to evaluate the current Article 6 services
and to recommend changes.

AN  ACT to create a task force on county public health services to study
  and make recommendations on the rules and regulations of  the  depart-
  ment  of  health  relating  to  the development of essential municipal
  health services; and providing for the repeal of such provisions  upon
  expiration thereof

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. A task force on county  public  health  services  shall  be
created  by  the  commissioner  of  health to examine, evaluate and make
recommendations concerning the scope of public health  services  adopted
by the department of health as stated in subparts 40-2 and 40-3 of title
10  of  the  official compilation of codes, rules and regulations of the
state of New York, and the municipal health plans  established  pursuant
thereto  and  pursuant to title 1 of article 6 of the public health law.
Such study and recommendations shall include, but not be limited to:
  (a) development of a list of optional services for which county health
departments are the sole providers;
  (b) evaluation of whether any particular service should be  reassigned
from subpart 40-2 to subpart 40-3 of such title 10;
  (c)  evaluation of whether any particular service should be reassigned
from subpart 40-3 to subpart 40-2 of such title 10;
  (d) determination of the need to expand services provided pursuant  to
title  1  of  article  6  of  the  public health law to include emerging
issues;
  (e) determination of  the  need  to  expand  the  number  of  optional
services  provided pursuant to title 1 of article 6 of the public health
law; and
  (f) establishment of statewide minimum standards  and  mechanisms  for
accountability  for effectively administering services provided pursuant
to title 1 of article 6 of the public health law.

  S 2. The task force on county public health services shall  be  estab-
lished  within  the  department  of  health  and  shall  consist of nine
members. The commissioner of health shall be a member of such task force
and serve as its chair. The remaining eight members shall  be  appointed
by  the commissioner of health.  The members of the task force shall all
have expertise in the area of public  health  plans.  In  addition,  the
appointed  members  shall  be  broadly  representative of the geographic
areas of the state.
  S 3. The members of the task force on county  public  health  services
shall  receive  no compensation for their services, but shall be allowed
their actual and necessary expenses incurred in the performance of their
duties pursuant to this act.
  S 4. To the extent feasible, the task force on  county  public  health
services  shall be entitled to request and receive and shall utilize and
be provided with such facilities,  resources  and  data  of  any  court,
department,  division,  board, bureau, commission or agency of the state
or any political subdivision thereof as it  may  reasonably  request  to
properly carry out its powers and duties pursuant to this act.
  S  5.  The  task  force  on county public health services shall make a
report to the governor and legislature of its findings, conclusions  and
recommendations  on  or  before the first of January next succeeding the
effective date of this act.
  S 6. This act shall take effect immediately and shall  expire  and  be
deemed repealed the second of January next succeeding the effective date
of this act.
