BILL NUMBER: S6935 TITLE OF BILL : An act to amend the general business law, in relation to cell phone contracts PURPOSE OR GENERAL IDEA : To reimburse consumers the prorated amount of their monthly cell phone service when the consumer terminates their contract. SUMMARY OF PROVISIONS : Section 1 states that providers shall refund to the customer a prorated amount equal to the difference between the number of days in a billing cycle and the days used by the customer during the course of that particular billing cycle. JUSTIFICATION : Currently if a consumer cancels his contract during a billing cycle they are forced to pay the entirety of that billing cycle. Under this legislation if a consumer was to cancel during that billing cycle they will be refunded back the prorated difference of time which service was not provided. For example during a 30 day billing cycle if a consumer cancels on the 15th day they would receive a 50% refund, on the 10th day a 67% refund for that particular months cost. FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to cell phone contracts THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 390-d to read as follows: S 390-D. CELL PHONE MINUTES. 1. IN THE EVENT A SERVICE CONTRACT IS CANCELLED BY THE CUSTOMER OF A MOBILE PHONE SERVICE CONTRACT, THE MOBILE OR CELLULAR PHONE SERVICE PROVIDER SHALL REFUND THE CUSTOMER, IN A PRO- RATED FASHION, THE DIFFERENCE BETWEEN THE NUMBER OF DAYS IN A BILLING CYCLE AND THE DAYS USED BY THE CUSTOMER DURING THE COURSE OF THE BILL- ING CYCLE IN WHICH THE CONTRACT IS CANCELLED. 2. THE DATE OF CANCELLATION SHALL BE THE DATE ON WHICH THE CUSTOMER INFORMS THE MOBILE OR CELLULAR PHONE SERVICE PROVIDER OF CANCELLATION. S 2. This act shall take effect immediately.
