Introduced  by  Sen.  HANNON -- read twice and ordered printed, and when
  printed to be committed to the Committee on Health

AN ACT to amend the public health law, in relation  to  prohibiting  the
  operation  of tanning facilities and the sale of ultraviolet radiation
  devices; and to repeal certain provisions of the public health law and
  the general business law relating to ultraviolet radiation devices

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Sections  3551,  3552,  3553, 3554 and 3555 of the public
health law are REPEALED, and a new section 3551  is  added  to  read  as
follows:
  S 3551. PROHIBITION. 1. NO PERSON SHALL OPERATE A TANNING FACILITY, OR
SELL OR OFFER FOR SALE ANY ULTRAVIOLET RADIATION DEVICE.
  2.  ANY  PERSON  WHO VIOLATES SUBDIVISION ONE OF THIS SECTION SHALL BE
GUILTY OF A CLASS A MISDEMEANOR, AS DEFINED IN THE PENAL LAW.
  S 2. Section 392-g of the general business law is REPEALED.
  S 3. This act shall take effect on the thirtieth day  after  it  shall
have become a law.
