AN ACT to amend the general business law, in relation to the approval of
  requests for insurance coverage for wheelchairs

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Article 32 of the general business law, as amended by chap-
ter 219 of the laws of 2006, is renumbered article 32-A.
  S 2. The article heading of article 32-A of the general business  law,
as  amended  by  chapter  219  of  the laws of 2006 and as renumbered by
section one of this act, is amended to read as follows:
                    [WHEELCHAIR WARRANTIES] WHEELCHAIRS
  S 3. Section 670 of the general business law, as  amended  by  chapter
219 of the laws of 2006, is renumbered section 677.
  S  4.  The  opening  paragraph  of subdivision 1 of section 677 of the
general business law, as amended by chapter 219 of the laws of 2006  and
as  renumbered  by  section  three  of  this  act, is amended to read as
follows:
  As used in this [section] ARTICLE:
  S 5. The general business law is amended by adding a new  section  678
to read as follows:
  S  678.  APPROVAL  OF  REQUESTS  FOR WHEELCHAIRS. AN INSURANCE COMPANY
LICENSED TO DO BUSINESS IN  THIS  STATE  THAT  RECEIVES  A  REQUEST  FOR
PAYMENT  FROM  A WHEELCHAIR DEALER OR MANUFACTURER WHOM A CLIENT OF SUCH
INSURANCE COMPANY HAS HIRED TO MANUFACTURE OR ASSEMBLE A WHEELCHAIR, FOR
PURPOSES OTHER THAN RESALE,  SHALL  INFORM  SUCH  WHEELCHAIR  DEALER  OR
MANUFACTURER  WITHIN  THIRTY DAYS OF RECEIPT OF SUCH REQUEST WHETHER THE
PURCHASE OF SUCH WHEELCHAIR IS COVERED BY THE INSURANCE  POLICY  OF  THE
CONSUMER.
  S  6.  This  act  shall take effect on the sixtieth day after it shall
have become a law.
