 TITLE OF BILL :

An act to amend chapter 192 of the laws of 2003, amending the
alcoholic beverage control law relating to the registration of kegs,
in relation to extending the provisions of such chapter


 PURPOSE :

This bill would extend until November 22, 2013 the the beer keg
registration requirements enacted by Chapter 192 of the Laws of 2003.

 SUMMARY OF PROVISIONS :

Section 1 of the bill would amend § 2 of Chapter 192 of the Laws of
2003, as amended by Chapter 316 of the Laws of 2009, by extending the
beer keg registration requirements until November 22, 2013.

Section 2 of the bill would provide for an immediate effective date.

 EXISTING LAW :

Alcoholic Beverage Control (ABC) Law § 105-c requires all kegs sold at
retail for off-premises consumption to have a registration tag
              

attached that indicates the name and address of the purchaser; the
purchaser's identification number (i.e. license number); the amount of
the container and registration deposits; the date and time of the
purchase; and the keg identification number.  This section is set to
expire on November 22, 2010.

 LEGISLATIVE HISTORY :

Chapter 632 of the Laws of 2008 extended the provisions of Chapter 192
of the Laws of 2003 until November 22, 2009 and Chapter 316 of the
Laws of 2009 extended Chapter 192 until November 22, 2010.

 STATEMENT IN SUPPORT :

Underage drinking continues to be a problem for our State. The purpose
of Chapter 192 of the Laws of 2003 was to make it easier for law
enforcement officials to track down the purchasers of kegs of beer
found at keg parties, which are often frequented by underage drinkers.
Research has shown that beer kegs are often a main source of alcohol
at parties where underage drinking occurs. In addition, kegs may
encourage greater amounts of alcohol consumption, increasing the risk
of driving under the influence of alcohol and other alcohol-related
problems.

Extending the keg registration requirements under the ABC Law will
continue to impose clearly stated responsibilities upon the purchasers
of kegs, which will deter underage drinking and excessive consumption.

 BUDGET IMPLICATIONS :

None.

 EFFECTIVE DATE :
This bill would be effective immediately.
