  printed to be committed to the Committee on Health

AN ACT to amend the public health law,  in  relation  to  real  property
  capital construction costs

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 6 of section 3614 of the public health  law  is
amended by adding a new paragraph (c) to read as follows:
  (C) FOR THE PERIOD EFFECTIVE APRIL FIRST, TWO THOUSAND TEN, REAL PROP-
ERTY  CAPITAL  CONSTRUCTION  COSTS SHALL BE INCLUDED IN RATES OF PAYMENT
FOR ALL ASSISTED LIVING PROGRAMS SIMILAR TO THE METHODOLOGY INDICATED IN
PARAGRAPH (B) OF THIS SUBDIVISION ONLY IF THE FACILITY  COMMENCED  OPER-
ATIONS  AFTER  DECEMBER  THIRTY-FIRST,  TWO  THOUSAND  NINE. THE CAPITAL
CONSTRUCTION  COSTS  SHALL  BE  LIMITED   TO   THE   MAXIMUM   ALLOWABLE
CONSTRUCTION  COSTS  PER BED THAT RESIDENTIAL HEALTH CARE FACILITIES ARE
LIMITED TO.
  S 2. This act shall take effect immediately.
