Introduced  by Sens. PERKINS, ADDABBO, PADAVAN, PARKER -- read twice and
  ordered printed, and when printed to be committed to the Committee  on
  Corporations, Authorities and Commissions

AN  ACT  relating to the various budgets of the metropolitan transporta-
  tion authority

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Notwithstanding  any provision of law to the contrary, in
the event that the metropolitan transportation authority receives or has
received American Recovery and Reinvestment  Act  of  2009  dollars  for
capital  purposes  and  improvements, the MTA shall transfer at least 30
million dollars originally allocated to  its  capital  budget  into  its
operating budget, to avert diminution in the level of service and safety
including  personnel directly serving the public in the normal course of
their duties in effect and prevailing on or about January 4, 2010,  and,
other  than reductions caused by normal attrition of its personnel serv-
ing the public, maintain such effort throughout the  state  fiscal  year
ending on March 31, 2011.
  S 2. This act shall take effect immediately.
