BILL NUMBER: S7555 TITLE OF BILL : An act in relation to authorizing the metropolitan transportation authority to submit two-year capital program plans to the metropolitan transportation authority capital program review board PURPOSE : This legislation would mandate that the MTA's capital plan commencing January 1, 2010, subject to approval of the capital program review board, be a two-year plan. SUMMARY OF SPECIFIC PROVISIONS : Section 1. states that the MTA capital plan commencing January 1, 2010 shall be a two-year plan however the submission of a two-year plan shall not permit the MTA to cease or reduce its five-year planning process. Section 2. Effective Date. JUSTIFICATION : Although New York State is in midst of a fiscal crisis, work on our mass transportation system needs to continue. By the MTA's own projections, the authority will only have enough revenue to pay for the first two years of any five year plan. Mandating the plan be

JOHNSON -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT in relation to authorizing the metropolitan transportation authority to submit two-year capital program plans to the metropolitan transportation authority capital program review board THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the two capital program plans for the five-year period commencing Janu- ary 1, 2010 required to be submitted by the metropolitan transportation authority to the metropolitan transportation authority capital program review board pursuant to section 1269-b of the public authorities law shall contain capital programs for only the two-year period from January 1, 2010 to December 31, 2011. Such two-year plans shall be approved or disapproved in the same manner as set forth in such section 1269-b, and all other provisions of such section shall continue to apply to such plans. The legislature recognizes that the needs of the metropolitan transportation authority should be addressed on a long-term stable basis, and this authorization for the submission of two-year capital program plans shall not permit the metropolitan transportation authority to cease or reduce its five-year planning process. On or before October 1, 2010, the metropolitan transportation authority shall submit amend- ments to these two-year plans to cover the five-year period commencing January 1, 2010, and hereafter no further two-year submissions shall be permitted. This section shall only apply to such two-year plans submit- ted for calendar years 2010 and 2011. S 2. This act shall take effect immediately.
