 TITLE OF BILL :

An act to amend the public health law, in relation to establishing the
arthritis disease management, outreach and education program


 PURPOSE :

Creates the arthritis disease management, outreach and education
program to improve and promote the availability of nationally
developed, evidence-based disease management programs, promote earlier
identification of the disease, provide information and assistance on
where to find services and community support and to promote public
awareness concerning arthritis.

 SUMMARY OF PROVISIONS :

Amends the public health law by adding a new Article 27-m which
creates the arthritis disease management, outreach and education
program, to improve and promote the availability of nationally
developed, evidence-based disease management programs, promote
identification and public awareness of arthritis with education and
information, training curriculum, and other similar efforts and
material for medical as well as non-medical personnel. The new section

also allows for, but does not require, the appointment of an advisory
council.

 JUSTIFICATION :

Arthritis is one of the most common chronic diseases in the United
States (U.S.), affecting 46 million adults. Furthermore, arthritis is
the leading chronic illness cause of self reported disability, with 16
million adults reporting activity limitations due to arthritis in 2002
(Hootman & Helmick, 2006). Nationally, arthritis is estimated to cost
$51 billion a year in direct medical costs and is responsible for
750,000 hospitalizations and 36 million outpatient physician visits
each year. In New York State, 57% of adults 65 years of age and older
and 39% of individuals between the ages of 45 and 64 reported a doctor
diagnosis of arthritis (U.S. Department of Health & Human Services,
Centers for Disease Control & Prevention, National Center for Chronic
Disease Prevention & Health Promotion, 2007).  Arthritis among New
Yorkers leads to retirement due to disability and the utilization of
health care and long term care services that could be avoided and/or
delayed as a result of successful self-management of arthritis.
Nationally developed, evidence based arthritis disease management
programs have been shown to be an effective means to increase
individuals' knowledge of arthritis and self efficacy in managing
their disease while decreasing symptoms of arthritis, such as pain and
stiffness, symptoms of depression, and social isolation.  Furthermore,
these programs have been shown to have a positive impact on health
care utilization and costs for individuals who participate when
compared to those who do not participate. Lastly, evidence suggests
that these disease management programs are effective across
populations of individuals with arthritis (Lorig, Gonzalez, & Ritter,
1999; Lorig, Ritter & Gonzalez, 2003).

Since 2002, with on-going support from a combination of state and
private funding, New York State based organizations representing
persons with arthritis have successfully worked together to
effectively build the statewide capacity for arthritis disease
management programs. Over the past eight years, these program efforts
have made an enormous impact on the 4 million state residents with
arthritis: improving the availability of nationally-developed,

evidence-based disease management programs and increasing public
awareness of arthritis programs to all residents across the state.

As we strive to control escalating health care costs while at the same
time improve outcomes and quality, it is important that the state
provide appropriate information, services, training and education to
providers and to the general public in order to ensure that arthritis
disease management happens earlier and residents are linked with the
appropriate supports to help provide a good quality of life while
managing their disease.

AN ACT to amend the public health law, in relation to  establishing  the
  arthritis disease management, outreach and education program

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The public health law is amended by adding  a  new  article
27-M to read as follows:
                              ARTICLE 27-M
                      ARTHRITIS DISEASE MANAGEMENT,
                     OUTREACH AND EDUCATION PROGRAM
SECTION  2799-T. ARTHRITIS  DISEASE  MANAGEMENT,  OUTREACH AND EDUCATION
                   PROGRAM.
  S  2799-T.  ARTHRITIS  DISEASE  MANAGEMENT,  OUTREACH  AND   EDUCATION
PROGRAM.    1.  THE COMMISSIONER IS AUTHORIZED AND DIRECTED TO ESTABLISH
THE ARTHRITIS DISEASE MANAGEMENT, OUTREACH  AND  EDUCATION  PROGRAM  FOR
MEDICAL AND NON-MEDICAL PROFESSIONALS AND PERSONNEL WHO PROVIDE SERVICES
TO  RESIDENTS  OF  THE  STATE,  AND FOR CONSUMERS, CAREGIVERS, AND OTHER
INDIVIDUALS AND ORGANIZATIONS WORKING WITH OR ON BEHALF OF PERSONS  WITH
ARTHRITIS. THE PURPOSE OF SUCH PROGRAM SHALL BE TO:
  (A) PROMOTE EARLIER IDENTIFICATION OF ARTHRITIS;
  (B)  PROMOTE  THE AVAILABILITY OF NATIONALLY DEVELOPED, EVIDENCE-BASED
DISEASE MANAGEMENT PROGRAMS;
  (C) PROVIDE INFORMATION AND ASSISTANCE  ON  WHERE  TO  FIND  COMMUNITY
SUPPORT SERVICES, INCLUDING SUPPORT GROUPS AND SERVICES, AND TO SERVE AS
A CLEARINGHOUSE FOR RELATED INFORMATION; AND
  (D)  PROMOTE  PUBLIC  AWARENESS  OF  AND  ACCESS TO SUCH RESOURCES AND
INFORMATION CONCERNING ARTHRITIS THAT THE COMMISSIONER  DEEMS  APPROPRI-
ATE.
  2.  THE  ARTHRITIS  DISEASE MANAGEMENT, OUTREACH AND EDUCATION PROGRAM
SHALL INCLUDE, BUT SHALL NOT BE LIMITED TO, THE FOLLOWING ELEMENTS:
  (A) ON-GOING TRAINING AND DEVELOPMENT  OF  CURRICULUM  AND  CERTIFYING
COURSE  INSTRUCTORS  RELATED  TO  BEST  PRACTICES  IN  ARTHRITIS DISEASE
MANAGEMENT PROGRAMS;

 EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

  (B) OFFERING FREE ARTHRITIS DISEASE MANAGEMENT PROGRAMS  AT  COMMUNITY
SITES THROUGHOUT THE STATE;
  (C)  RESEARCH  AND  DOCUMENTING OF HEALTH OUTCOMES FOR PROGRAM PARTIC-
IPANTS;
  (D) PROMOTING PUBLIC EDUCATION AND AWARENESS THROUGH  DISTRIBUTION  OF
INFORMATIONAL  MATERIALS  AT  PUBLIC ACCESS POINTS AND FORUMS THROUGHOUT
THE STATE; AND
  (E) ESTABLISHMENT  OF  TOLL-FREE  TELEPHONE  HOTLINES  AND  ELECTRONIC
SERVICES TO PROVIDE INFORMATION.
  3.  THE  DEPARTMENT SHALL PRODUCE AND MAKE AVAILABLE TO THE PUBLIC FOR
REPRODUCTION,  OR  CONTRACT  WITH  OTHERS  TO  DEVELOP  SUCH   MATERIALS
MENTIONED  IN  THIS SECTION AS THE COMMISSIONER DEEMS APPROPRIATE. THESE
MATERIALS SHALL BE MADE AVAILABLE TO THE PUBLIC FREE OF CHARGE AS APPRO-
PRIATE OR FOR A FEE UNDER CERTAIN CIRCUMSTANCES.   THE COMMISSIONER  MAY
REQUIRE  ANY  HEALTH  CARE PROVIDER TO MAKE THESE MATERIALS AVAILABLE TO
PATIENTS WHERE APPROPRIATE AND ENCOURAGE NON-MEDICAL  PROFESSIONALS  AND
PERSONNEL TO MAKE THEM AVAILABLE TO THE CLIENTS THEY SERVE.
  4.  IN  EXERCISING  ANY  OF  HIS OR HER POWERS UNDER THIS SECTION, THE
COMMISSIONER SHALL CONSULT WITH APPROPRIATE  HEALTH  CARE  PROFESSIONALS
AND  PROVIDERS,  COMMUNITY SERVICE PROVIDERS, ORGANIZATIONS REPRESENTING
PERSONS WITH ARTHRITIS, CONSUMERS, PATIENTS, AND  ORGANIZATIONS  REPRES-
ENTING PATIENTS.
  5.  THE  COMMISSIONER  SHALL ENSURE THAT ALL INFORMATION AND MATERIALS
PRODUCED UNDER THIS SECTION ARE MAINTAINED AND UPDATED TO  REFLECT  BEST
PRACTICE  RECOMMENDATIONS,  AND ARE CULTURALLY AND LINGUISTICALLY APPRO-
PRIATE FOR THE COMMUNITIES SERVED BY THE ARTHRITIS  DISEASE  MANAGEMENT,
OUTREACH  AND  EDUCATION  PROGRAM.  THE DEPARTMENT SHALL POST ELECTRONIC
COPIES OF OUTREACH MATERIAL, INCLUDING BEST PRACTICES, ON  ITS  INTERNET
WEBSITE.
  6.  THE  COMMISSIONER  MAY  APPOINT AN ADVISORY COUNCIL RELATED TO THE
VARIOUS MATTERS ADDRESSED BY THIS SECTION. SUCH  COUNCIL  SHALL  INCLUDE
REPRESENTATION   OF  HEALTH  CARE  PROFESSIONALS,  PROVIDERS,  COMMUNITY
SERVICE PROVIDERS, ORGANIZATIONS REPRESENTING  PERSONS  WITH  ARTHRITIS,
CONSUMERS,  PATIENTS AND OTHER APPROPRIATE INTERESTS. THE MEMBERS OF THE
COUNCIL SHALL RECEIVE NO COMPENSATION FOR THEIR SERVICES, BUT  SHALL  BE
ALLOWED  THEIR  ACTUAL AND NECESSARY EXPENSES INCURRED IN PERFORMANCE OF
THEIR DUTIES.
  7. IN ADDITION TO SUCH MONEY AS MAY BE APPROPRIATED FOR  THE  PURPOSES
OF  THIS  SECTION,  THE  COMMISSIONER  MAY  ACCEPT GRANTS FROM PUBLIC OR
PRIVATE SOURCES. THE COMMISSIONER, IN ADMINISTERING THIS SECTION,  SHALL
SEEK TO COORDINATE PROGRAMS AND ACTIVITIES UNDER THIS SECTION WITH OTHER
PUBLIC  AND  PRIVATE  PROGRAMS,  AND  MAY UNDERTAKE JOINT OR COOPERATIVE
PROGRAMS WITH OTHER PUBLIC OR PRIVATE ENTITIES.
  8. THE COMMISSIONER MAY PROMULGATE SUCH RULES AND REGULATIONS AS SHALL
BE NECESSARY AND APPROPRIATE FOR THE IMPLEMENTATION OF THE PROVISIONS OF
THIS SECTION.
  S 2. This act shall take effect immediately.
