Introduced  by Sen. DILAN -- (at request of the Metropolitan Transporta-
  tion Authority Inspector General) -- read twice and  ordered  printed,
  and when printed to be committed to the Committee on Transportation

AN ACT to amend the public authorities law, in relation to requiring MTA
  officers and employees to report serious misconduct to the MTA inspec-
  tor general

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 1279 of the public authorities law  is  amended  by
adding a new subdivision 8 to read as follows:
  8.  EVERY  OFFICER  OR  EMPLOYEE  OF  THE   AUTHORITY, THE LONG ISLAND
RAILROAD, METRO NORTH RAILROAD, METROPOLITAN SUBURBAN BUS AUTHORITY, THE
STATEN ISLAND RAPID TRANSIT OPERATING AUTHORITY, THE  TRIBOROUGH  BRIDGE
AND  TUNNEL  AUTHORITY,  THE  NEW  YORK  CITY  TRANSIT AUTHORITY AND ITS
SUBSIDIARY, THE MANHATTAN AND BRONX SURFACE TRANSIT OPERATING AUTHORITY,
OR ANY OTHER AGENCY THAT MAY COME UNDER THE CONTROL OF THE AUTHORITY, OR
WITHIN THEIR CUSTODY OR CONTROL, MUST REPORT PROMPTLY TO  THE  INSPECTOR
GENERAL ANY INFORMATION CONCERNING CORRUPTION, FRAUD, CRIMINAL ACTIVITY,
CONFLICTS  OF  INTEREST OR ABUSE BY ANOTHER OFFICER OR EMPLOYEE RELATING
TO HIS OR HER OFFICE OR EMPLOYMENT, OR BY A PERSON HAVING BUSINESS DEAL-
INGS WITH THE AUTHORITY OR ANY OF THE  FOREGOING  AGENCIES  RELATING  TO
THOSE  DEALINGS.  THE  KNOWING  FAILURE OF ANY OFFICER OR EMPLOYEE TO SO
REPORT SHALL BE CAUSE FOR REMOVAL FROM OFFICE  OR  EMPLOYMENT  OR  OTHER
APPROPRIATE  PENALTY.  ANY OFFICER OR EMPLOYEE WHO ACTS PURSUANT TO THIS
SUBDIVISION BY REPORTING TO THE INSPECTOR GENERAL IMPROPER  GOVERNMENTAL
ACTION  AS  DEFINED  IN  SECTION SEVENTY-FIVE-B OF THE CIVIL SERVICE LAW
SHALL NOT BE SUBJECT TO DISMISSAL, DISCIPLINE OR OTHER ADVERSE PERSONNEL
ACTION.
  S 2. This act shall take effect on the sixtieth  day  after  it  shall
have become a law.
