BILL NUMBER: S7624 TITLE OF BILL : An act to amend the education law, in relation to biennial testing for school bus drivers PURPOSE OR GENERAL IDEA OF BILL : To allow portability of successfully completed biennial state mandated bus driver tests between school districts. SUMMARY OF SPECIFIC PROVISIONS : Section one amends section 3624 of the education law by adding new subdivision 2 to direct the Commissioner of Education to adopt and promulgate rules and regulations that would require that successfully completed biennial state mandated school bus driver tests be portable between school districts. Section two defines the effective date as immediately. JUSTIFICATION : Allowing school bus drivers to retain their test certification upon a change of employer extends to them a prerogative that is consistent with similar certification requirements. For example, if a school bus driver passes the required. biennial physical performance test, the driver is not required to take that test again upon a change of

STEWART-COUSINS -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to biennial testing for school bus drivers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The opening paragraph of section 3624 of the education law is designated subdivision 1 and a new subdivision 2 is added to read as follows: 2. THE COMMISSIONER SHALL ADOPT AND PROMULGATE RULES AND REGULATIONS REQUIRING THAT SUCCESSFULLY COMPLETED BIENNIAL STATE MANDATED BUS DRIVER TESTS PURSUANT TO 15 NYCRR 6.11 (A)-(B) AND 15 NYCRR 6.12 (A)-(B) BE PORTABLE BETWEEN SCHOOL DISTRICTS.
