BILL NUMBER: S7642 TITLE OF BILL : An act granting retroactive membership with tier II status in the New York state and local employees' retirement system to Warren Greene SUMMARY OF SPECIFIC PROVISIONS : Authorizes Warren Greene Tier II status in the New York State and Local Employees' Retirement System. JUSTIFICATION : Warren Greene first became eligible to join a public retirement system when he began working for the City of Gloversville on July 15, 1974. Mr. Greene worked for the City of Gloversville as the Playground Director of Littauer Pool Playground from July 15, 1974 until July 31, 1974 and again from August 15, 1974 until August 31, 1974. However, during this period of time he was not afforded the opportunity to join the system. This bill would allow Mr. Greene to be deemed to have become a member of the New York State and Local Employees' Retirement system as of July 15, 1974. FISCAL IMPLICATIONS : This bill will deem Warren S. Greene, currently a retired Tier 3 member of the New York State and Local Employees' Retirement System, to have first become a member of the Retired System on July 15, 1974,

BUTLER -- read once and referred to the Committee on Governmental Employees AN ACT granting retroactive membership with tier II status in the New York state and local employees' retirement system to Warren Greene THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other law to the contrary, Warren Greene, who was employed by the city of Gloversville as the playground director of Littauer Pool Playground from July 15, 1974 through July 31, 1974 and from August 15, 1974 through August 31, 1974, and who is currently a retired member of the New York state and local employees' retirement system, who through no fault of his own did not become a member of the New York state and local employees' retirement system in July of 1974 when first employed by the city of Gloversville, shall be deemed to have become a member of the New York state and local employ- ees' retirement system on July 15, 1974, and shall be granted every right, benefit and privilege which would have been available on such date, provided that an application is filed with the state comptroller within one year from the effective date of this act. S 2. Notwithstanding any other provision of law, no employee contrib- utions shall be returned to Warren Greene pursuant to this act. S 3. This act shall take effect immediately. FISCAL NOTE.--Pursuant to Legislative Law, Section 50: This bill will deem Warren S. Greene, currently a retired Tier 3 member of the New York State and Local Employees' Retirement System, to have first become a member of the Retirement System on July 15, 1974, thereby making him eligible for reinstatement to Tier 2. Mr. Greene will not receive a refund of his Tier 3 member contributions. If this bill is enacted, there will be an immediate past service cost of approximately $42,500 which will be shared by the State of New York EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
