BILL NUMBER: S7897 TITLE OF BILL : An act to amend the vehicle and traffic law, in relation to vehicles passing bicycles on roadways PURPOSE OR GENERAL IDEA OF BILL : To improve the safety of bicyclists who ride on the right side of the roadway by providing that when a vehicle overtakes or passes a bicyclist or bicyclists, he or she shall do so at a safe distance from the left side of the bicycle SUMMARY OF SPECIFIC PROVISIONS : Section one amends paragraph 2 of subdivision (a) of section 1120 of the vehicle and traffic law, as amended by chapter 653 of the laws of 1964, by adding overtaking or passing bicyclists on the right half of the roadway to the list of exceptions to when a vehicle must drive on the right hand side of the road. Section two amends the vehicle and traffic law by adding a new section 1122-a which provides that when overtaking a bicycle from behind and proceeding on the same side of a roadway, the operator of a vehicle shall pass to the left of the bicycle at a safe distance until the vehicle safely clears the bicyclist.

STEWART-COUSINS -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to vehicles passing bicycles on roadways THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph 2 of subdivision (a) of section 1120 of the vehi- cle and traffic law, as amended by chapter 653 of the laws of 1964, is amended to read as follows: 2. When overtaking or passing BICYCLISTS, pedestrians, animals or obstructions on the right half of the roadway; S 2. The vehicle and traffic law is amended by adding a new section 1122-a to read as follows: S 1122-A. OVERTAKING A BICYCLE. THE OPERATOR OF A VEHICLE OVERTAKING, FROM BEHIND, A BICYCLE PROCEEDING ON THE SAME SIDE OF A ROADWAY SHALL PASS TO THE LEFT OF SUCH BICYCLE AT A SAFE DISTANCE UNTIL SAFELY CLEAR THEREOF. S 3. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
