  and when printed to be committed to the Committee on Transportation

AN ACT to amend the vehicle and traffic law,  in  relation  to  vehicles
  passing bicycles on roadways

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Paragraph 2 of subdivision (a) of section 1120 of the vehi-
cle and traffic law, as amended by chapter 653 of the laws of  1964,  is
amended to read as follows:
  2.  When  overtaking  or  passing  BICYCLISTS, pedestrians, animals or
obstructions on the right half of the roadway;
  S 2. The vehicle and traffic law is amended by adding  a  new  section
1122-a to read as follows:
  S  1122-A. OVERTAKING A BICYCLE. THE OPERATOR OF A VEHICLE OVERTAKING,
FROM BEHIND, A BICYCLE PROCEEDING ON THE SAME SIDE OF  A  ROADWAY  SHALL
PASS  TO  THE LEFT OF SUCH BICYCLE AT A SAFE DISTANCE UNTIL SAFELY CLEAR
THEREOF.
  S 3. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
