BILL NUMBER:S8142 TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to establishing the offense of knowingly authorizing an unlicensed driver to operate a motor vehicle PURPOSE OR GENERAL IDEA OF BILL: This legislation creates the penalty of knowingly authorizing an unli- censed or suspended driver to operate a motor vehicle in order to stiff- en penalties related to such crime. SUMMARY OF SPECIFIC PROVISIONS: This bill increases the penalties relating to the knowingly authori- zation of operating a motor vehicle by persons unlicensed or persons with a suspended license. This legislation will hold the individual to whom the vehicle is registered liable for any and all offenses committed by the unlicensed or suspended license operator and any damages caused by said person. Furthermore, a civil penalty of $1 , 000 per violation by the unlicensed or suspended license person will be issued to the registered owner of the motor vehicle. Violation of this new section will result in a class A misdemeanor. FOLEY -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to establishing the offense of knowingly authorizing an unlicensed driver to operate a motor vehicle THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The vehicle and traffic law is amended by adding a new section 1212-a to read as follows: S 1212-A. KNOWINGLY AUTHORIZING AN UNLICENSED OR SUSPENDED DRIVER TO OPERATE A MOTOR VEHICLE. 1. AN INDIVIDUAL IS GUILTY OF KNOWINGLY AUTHOR- IZING AN UNLICENSED OR SUSPENDED DRIVER TO OPERATE A MOTOR VEHICLE WHEN HE OR SHE ENABLES OR AUTHORIZES ANOTHER PERSON TO OPERATE A MOTOR VEHI- CLE OWNED OR REGISTERED TO SUCH INDIVIDUAL WITH THE KNOWLEDGE THAT SUCH OTHER PERSON DOES NOT HAVE A VALID DRIVER'S LICENSE PURSUANT TO TITLE FIVE OF THIS CHAPTER. 2. ANY INDIVIDUAL FOUND GUILTY OF KNOWINGLY AUTHORIZING AN UNLICENSED OR SUSPENDED DRIVER TO OPERATE A MOTOR VEHICLE SHALL BE SUBJECT TO: (A) LIABILITY FOR ANY OFFENSE COMMITTED BY OR ANY DAMAGES CAUSED BY SUCH UNLICENSED OR SUSPENDED DRIVER; AND (B) A CIVIL PENALTY OF ONE THOUSAND DOLLARS PER VIOLATION. KNOWINGLY AUTHORIZING AN UNLICENSED OR SUSPENDED DRIVER TO OPERATE A MOTOR VEHICLE IS A CLASS A MISDEMEANOR. S 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law.
