AN ACT to amend the vehicle and traffic law, in relation to establishing
  the offense of knowingly authorizing an unlicensed driver to operate a
  motor vehicle

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  The  vehicle  and  traffic law is amended by adding a new
section 1212-a to read as follows:
  S 1212-A. KNOWINGLY AUTHORIZING AN UNLICENSED OR SUSPENDED  DRIVER  TO
OPERATE A MOTOR VEHICLE. 1. AN INDIVIDUAL IS GUILTY OF KNOWINGLY AUTHOR-
IZING  AN UNLICENSED OR SUSPENDED DRIVER TO OPERATE A MOTOR VEHICLE WHEN
HE OR SHE ENABLES OR AUTHORIZES ANOTHER PERSON TO OPERATE A MOTOR  VEHI-
CLE  OWNED OR REGISTERED TO SUCH INDIVIDUAL WITH THE KNOWLEDGE THAT SUCH
OTHER PERSON DOES NOT HAVE A VALID DRIVER'S LICENSE  PURSUANT  TO  TITLE
FIVE OF THIS CHAPTER.
  2.  ANY INDIVIDUAL FOUND GUILTY OF KNOWINGLY AUTHORIZING AN UNLICENSED
OR SUSPENDED DRIVER TO OPERATE A MOTOR VEHICLE SHALL BE SUBJECT TO:
  (A) LIABILITY FOR ANY OFFENSE COMMITTED BY OR ANY  DAMAGES  CAUSED  BY
SUCH UNLICENSED OR SUSPENDED DRIVER; AND
  (B) A CIVIL PENALTY OF ONE THOUSAND DOLLARS PER VIOLATION.
  KNOWINGLY  AUTHORIZING  AN UNLICENSED OR SUSPENDED DRIVER TO OPERATE A
MOTOR VEHICLE IS A CLASS A MISDEMEANOR.
  S 2. This act shall take effect on the first of November next succeed-
ing the date on which it shall have become a law.
