TITLE OF BILL:
An act
to amend the criminal procedure law, in relation to prohibiting peace
officers from inquiring about the nationality or immigration status of a
victim or witness
to a criminal offense
PURPOSE OR GENERAL IDEA OF BILL:
Provide victims and witnesses the
opportunity to come forward about crimes without fear of actions
dealing with retribution and/or detrimental effect to their
immigration status.
SUMMARY OF SPECIFIC PROVISION:
Section 1. The criminal procedure law
is amended by adding new section 2.25 to read as follows:
Section 2.25 Prohibitions on peace officers
A peace officer may not inquire as to the nationality or immigration
status of victim of or witness to a criminal offense except as
necessary to investigate the offense.

AN ACT to amend the criminal procedure law, in relation to prohibiting

THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
Section 1. The criminal procedure law is amended by adding a new
section 2.25 to read as follows:
S 2.25 PROHIBITIONS ON PEACE OFFICERS.
A PEACE OFFICER MAY NOT INQUIRE AS TO THE NATIONALITY OR IMMIGRATION
STATUS OF A VICTIM OF OR WITNESS TO A CRIMINAL OFFENSE EXCEPT AS NECES-
SARY TO INVESTIGATE THE OFFENSE.
S 2. This act shall take effect immediately.
EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
[ ] is old law to be omitted.
