2009-S911 (ACTIVE) - Summary

Prohibits individuals, firms, corporations or associations from engaging in the killing or injuring of confined animals for the purpose of entertainment, contest or any other reason; prohibits a premises from being licensed as a "shooting preserve" for the purpose of such practice, commonly referred to as "canned hunting" or "domestic safaris"; subjects violators to civil penalties of not less than five thousand dollars nor more than ten thousand dollars for each violation.

AN ACT to amend the  environmental  conservation  law,  in  relation  to
  shooting preserves

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The opening paragraph of subdivision 9 of  section  11-1903
of the environmental conservation law is designated paragraph a and four
new paragraphs b, c, d and e are added to read as follows:
  B.    NO  INDIVIDUAL, FIRM, CORPORATION OR ASSOCIATION SHALL ENGAGE IN
THE KILLING OR INJURING OF ANY CONFINED ANIMALS: WILD, DOMESTIC,  EXOTIC
OR  INDIGENOUS,  NOT  INCLUDING  PREDATORY  WILDLIFE DISTURBING DOMESTIC
GAME, FOR THE PURPOSES OF ENTERTAINMENT, CONTEST OR ANY OTHER REASON.
  C. ANY INDIVIDUAL, FIRM, CORPORATION, ASSOCIATION, OR PARTNERSHIP THAT
VIOLATES THE PROVISIONS OF THIS SUBDIVISION IS SUBJECT TO A CIVIL PENAL-
TY OF NOT LESS THAN FIVE THOUSAND DOLLARS NOR  MORE  THAN  TEN  THOUSAND
DOLLARS FOR EACH VIOLATION.
  D.  NO  PREMISES  MAY  BE  LICENSED  AS  "SHOOTING  PRESERVES" FOR THE
PURPOSES OF "CANNED HUNTING" OR "DOMESTIC SAFARIS"  WHEREIN  A  LICENSEE
MAY  CHARGE  A DAILY FEE OR CHARGE A FEE FOR EACH CONFINED ANIMAL KILLED
OR A COMBINATION THEREOF.
  E. AS USED IN THIS SUBDIVISION, "CONFINED  ANIMAL"  MEANS  ANY  MAMMAL
THAT HAS BEEN HELD IN CAPTIVITY FOR ANY AMOUNT OF TIME OR REASON WHETHER
OR NOT THE LICENSEE KNOWS THE LENGTH OF CAPTIVITY.
  S 2. This act shall take effect on the one hundred eightieth day after
it shall have become a law.
