AN ACT to amend the education law, in relation to requiring that tuition
  paid  for  public  higher education be used for the purposes of higher
  education

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 355 of the education law is amended by adding a new
subdivision 4-a to read as follows:
  4-A.  NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY, ALL MONEYS
AND REVENUE DERIVED FROM THE  PAYMENT  OF  TUITION  AT  ANY  COLLEGE  OR
UNIVERSITY OF THE STATE UNIVERSITY OF NEW YORK SHALL BE DEPOSITED IN AND
CREDITED  TO  A  SEPARATE  ACCOUNT.  THE MONEYS IN SUCH ACCOUNT SHALL BE
EXPENDED SOLELY FOR THE FUNDING OF PUBLIC  HIGHER  EDUCATION.  UNDER  NO
CIRCUMSTANCE  SHALL  THE  MONEYS  IN SUCH ACCOUNT BE COMMINGLED WITH ANY
OTHER MONEYS.
  S 2. Section 6221 of the education law is  amended  by  adding  a  new
subdivision F to read as follows:
  F.  NOTWITHSTANDING  ANY  PROVISION OF LAW TO THE CONTRARY, ALL MONEYS
AND REVENUE DERIVED FROM THE PAYMENT OF TUITION AT ANY  COLLEGE  OF  THE
CITY  UNIVERSITY  OF  NEW  YORK  SHALL BE DEPOSITED IN AND CREDITED TO A
SEPARATE ACCOUNT. THE MONEYS IN SUCH ACCOUNT SHALL  BE  EXPENDED  SOLELY
FOR THE FUNDING OF PUBLIC HIGHER EDUCATION. UNDER NO CIRCUMSTANCES SHALL
THE MONEYS IN SUCH ACCOUNT BE COMMINGLED WITH ANY OTHER MONEYS.
  S  3.  Section  6304  of  the education law is amended by adding a new
subdivision 14 to read as follows:
  14. NOTWITHSTANDING ANY PROVISION OF LAW TO THE CONTRARY,  ALL  MONEYS
AND REVENUE DERIVED FROM THE PAYMENT OF TUITION AT ANY COMMUNITY COLLEGE
SHALL  BE DEPOSITED IN AND CREDITED TO A SEPARATE ACCOUNT. THE MONEYS IN
