AN ACT to amend the social services law,  in  relation  to  making  live
  organ  donors  eligible  for free coverage from family health plus; to
  amend the insurance law, in relation to providing for a free term life
  insurance policy for live organ donors; and  to  amend  the  education
  law,  in  relation  to  creating  a post-graduation tuition assistance
  program for live organ donors

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Paragraph  (a)  of subdivision 2 of section 369-ee of the
social services law is amended by adding a new subparagraph (vi) to read
as follows:
  (VI) HAS DONATED AN ORGAN IN THE PREVIOUS TWELVE MONTHS. AN INDIVIDUAL
ELIGIBLE UNDER THIS PARAGRAPH SHALL BE ELIGIBLE FOR HEALTH CARE SERVICES
UNDER THIS SECTION NOTWITHSTANDING ANY ADDITIONAL  ELIGIBILITY  REQUIRE-
MENTS  OUTLINED  IN  THIS SUBDIVISION. SUCH PERSON SHALL BE ELIGIBLE FOR
HEALTH CARE SERVICES UNDER THIS SECTION  WITHOUT  PAYMENT  OF  PREMIUMS;
PROVIDED,  HOWEVER, THAT SUCH PERSON SHALL BE RESPONSIBLE FOR PAYMENT OF
CO-PAYMENTS AND  OTHERWISE  SUBJECT  TO  THE  LIMITATIONS  OF  COST  AND
SERVICES PROVIDED FOR IN THIS SECTION.
  S 2. The insurance law is amended by adding a new section 3240 to read
as follows:
  S  3240.  TERM LIFE INSURANCE FOR ORGAN DONATION. 1. AN INDIVIDUAL WHO
HAS MADE A LIVE DONATION TO A REGISTERED ORGAN DONATION ORGANIZATION  OR
REGISTRY  SHALL  RECEIVE  A  FIVE  YEAR TERM LIFE INSURANCE POLICY, UPON
APPLICATION TO THE DEPARTMENT, SO LONG AS SUCH APPLICATION  IS  RECEIVED
WITHIN  TWELVE MONTHS OF THE DATE OF DONATION. SUCH APPLICATION SHALL BE
ON FORMS PRESCRIBED BY THE SUPERINTENDENT.
  2. THE TERMS AND CONDITIONS OF SUCH POLICY SHALL BE PROMULGATED BY THE
SUPERINTENDENT, AS WELL AS  WHETHER  SUCH  POLICY  SHALL  BE  RENEWABLE;
