AN ACT to amend the education law, in relation to the appointment of the
  members of the board of education of the city school district  of  the
  city of Yonkers

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Subdivision 3 of section 2553  of  the  education  law,  as
added by chapter 242 of the laws of 1974, is amended to read as follows:
  3.  In  the city school district of the city of Yonkers members of the
board of education shall be appointed from the  city  at  large  by  the
mayor  and  shall be for terms of five years each, to begin on the first
Tuesday in May. PROVIDED THAT NO PERSON WHO IS AN OFFICER  OR  EMPLOYEE,
IN  A  PAID  CAPACITY  AND  REGARDLESS  OF WHETHER SUCH POSITION IS ON A
FULL-TIME OR PART-TIME BASIS, OF THE CITY OF YONKERS OR ANY PUBLIC BENE-
FIT CORPORATION WHICH IS FUNDED DIRECTLY OR THROUGH SUBCONTRACT  BY  THE
MONIES OF OR CONTRIBUTIONS FROM SUCH CITY, SHALL BE ELIGIBLE TO SERVE AS
A  MEMBER  OF  THE BOARD OF EDUCATION OF THE CITY SCHOOL DISTRICT OF THE
CITY OF YONKERS. THE MAYOR SHALL MAKE APPOINTMENTS OF  SUCH  MEMBERS  TO
REFLECT  THE  DIVERSITY,  IN  GENDER AND ETHNIC HERITAGE, OF THE CITY OF
YONKERS.
  S 2. This act  shall  take  effect  immediately  and  shall  apply  to
appointments  to  fill  vacancies  on the board of education of the city
school district of the city of Yonkers on or after such effective date.
