AN  ACT  to amend the executive law, in relation to requiring members of
  the division of state police to be  provided  with  bullet  and  knife
  proof protective vests

  THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. Section 212 of the executive law, as amended by chapter  83
of the laws of 1995, is amended to read as follows:
  S 212. Equipment.  1. The superintendent OF STATE POLICE is authorized
on behalf of the state to purchase, lease or lease-purchase, within  the
amounts appropriated therefor, necessary equipment and supplies, includ-
ing but not limited to, vehicles and aircraft subject to the approval of
the  director of the budget, and uniforms; when any state property shall
become unfit for use it shall be disposed  of  in  accordance  with  the
provisions of the STATE finance law.
  2.  THE  SUPERINTENDENT  OF STATE POLICE SHALL PROVIDE EVERY MEMBER OF
THE DIVISION OF STATE POLICE WHO PERFORMS LAW ENFORCEMENT DUTIES WITH  A
BULLET  AND  KNIFE  PROOF  VEST  THAT  PROVIDES  FRONT,  BACK  AND  SIDE
PROTECTION AND IS DESIGNATED AS NOT LESS THAN A LEVEL III-A VEST BY  THE
NATIONAL  INSTITUTE  FOR JUSTICE.   THE SUPERINTENDENT SHALL PROVIDE FOR
THE MONTHLY INSPECTION OF SUCH VESTS. ANY VEST THAT DOES NOT COMPLY WITH
THE PROVISIONS OF THIS SUBDIVISION OR WHICH THE SUPERINTENDENT DEEMS  TO
BE  OTHERWISE  UNFIT  SHALL BE DISCARDED IMMEDIATELY AND REPLACED WITH A
VEST WHICH COMPLIES WITH THIS SUBDIVISION AND IS APPROVED BY THE  SUPER-
INTENDENT.
  S 2. This act shall take effect immediately.
