AN  ACT to amend the public health law, in relation to warning labels on
  ultraviolet radiation devices

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section  1.  Paragraph  (d)  of  subdivision  2 of section 3554 of the
public health law, as added by chapter 378  of  the  laws  of  1990,  is
amended and a new paragraph (e) is added to read as follows:
  (d)  requiring each tanning facility to provide safety goggles and any
other safety-related devices  to  customers  without  additional  charge
therefor[.]; AND
  (E)  REQUIRING  EACH  TANNING  FACILITY  TO CONSPICUOUSLY POST ON EACH
ULTRAVIOLET RADIATION DEVICE LABELS THAT SUFFICIENTLY  INFORM  CONSUMERS
REGARDING  THE  RISKS THAT THE USE OF SUCH DEVICES POSE FOR THE DEVELOP-
MENT OF IRREVERSIBLE DAMAGE TO THE EYES AND SKIN, INCLUDING SKIN CANCER.
  S 2. This act shall take effect immediately.
