Requires governing body of a school district which proposed the elimination of any position of a teacher of science, mathematics, special education, language arts or English language learners, because of economic conditions, to first propose elimination of funding for interscholastic sports; directs the education department to develop and implement plans for the elimination of funding for interscholastic sports programs in school districts which have budget reductions which entail elimination of teaching positions in such subjects.

P. RIVERA -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to requiring the govern- ing body of each school district, which eliminates certain teaching positions for any school year, to eliminate funding for interscholas- tic sports programs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 1527-a to read as follows: S 1527-A. SCHOOL BUDGET REDUCTIONS. DURING THE CONSIDERATION AND ADOPTION OF THE PROPOSED SCHOOL DISTRICT BUDGET FOR ANY SCHOOL YEAR IN WHICH THERE IS THE PROPOSED ELIMINATION OF ANY POSITION OF A TEACHER OF SCIENCE, MATHEMATICS, SPECIAL EDUCATION, LANGUAGE ARTS OR ENGLISH LANGUAGE LEARNERS FROM THE IMMEDIATELY PRECEDING SCHOOL YEAR, BECAUSE OF ECONOMIC CONDITIONS, THE GOVERNING BODY OF THE SCHOOL DISTRICT SHALL FIRST INCLUDE IN SUCH PROPOSED BUDGET ELIMINATION OF FUNDING FOR INTER- SCHOLASTIC SPORTS PROGRAMS. S 2. On or before December 1, 2011, the education department shall develop and implement, by rule, a plan for every school district which reduces its budget, because of New York state's worsening economic conditions, requiring each such district to eliminate funding for inter- scholastic sports programs before it proposes elimination of mathemat- ics, science, language arts, special education or English language lear- ners teachers.
