AN ACT to amend the education law, in relation to adding a regional cost
  of living factor into any category of aid to school districts in which
  a statewide formula is used

  THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
BLY, DO ENACT AS FOLLOWS:

  Section 1. The education law is amended by adding a new section 3602-g
to read as follows:
  S 3602-G. REGIONAL COST FACTOR. 1. IN ADDITION TO ANY OTHER APPORTION-
MENT,  FOR AID PAYABLE IN THE TWO THOUSAND ELEVEN -- TWO THOUSAND TWELVE
SCHOOL YEAR AND THEREAFTER, A SCHOOL DISTRICT SHALL BE ELIGIBLE  FOR  AN
APPORTIONMENT  UNDER  THE  PROVISIONS OF THIS SECTION TO ACCOUNT FOR THE
HIGHER COST OF PROVIDING A PUBLIC EDUCATION  IN  CERTAIN  AREAS  OF  THE
STATE.  A  SCHOOL  DISTRICT'S  APPORTIONMENT UNDER THIS SECTION SHALL BE
COMPUTED BY MULTIPLYING THE APPROPRIATE  REGIONAL  COST  FACTOR  BY  THE
TOTAL AMOUNT OF FORMULA AIDS PAYABLE TO SUCH DISTRICT UNDER SUBDIVISIONS
NINE,  TWELVE, AND THIRTEEN, PARAGRAPHS D AND F OF SUBDIVISION FOURTEEN,
AND SUBDIVISION SIXTEEN OF SECTION THIRTY-SIX HUNDRED TWO OF THIS  ARTI-
CLE,  SUBDIVISIONS  FOUR, SIX, AND SEVEN OF SECTION SEVEN HUNDRED ONE OF
THIS CHAPTER, SUBDIVISION FOUR OF SECTION SEVEN HUNDRED ELEVEN  OF  THIS
CHAPTER,  SECTION  SEVEN  HUNDRED FIFTY-ONE OF THIS CHAPTER, AND SECTION
THIRTY-SIX HUNDRED TWO-E OF THIS ARTICLE IN THE CURRENT YEAR.
  2. THE COMMISSIONER, IN CONSULTATION WITH  THE  DEPARTMENT  OF  LABOR,
SHALL ANNUALLY COMPUTE THE REGIONAL COST FACTORS FOR THE VARIOUS REGIONS
OF  THE  STATE.  IN  MAKING  SUCH  COMPUTATIONS,  THE COMMISSIONER SHALL
CONSIDER, AT A MINIMUM, THE COST TO SCHOOL DISTRICTS  OF  PROVIDING  FOR
EMPLOYEES'  SALARIES,  STUDENTS'  TRANSPORTATION, AND THE ACQUISITION OF
VARIOUS GOODS AND SERVICES; PROVIDED, HOWEVER, THAT IN NO CASE SHALL THE
REGIONAL COST FACTOR EXCEED FIVE HUNDREDTHS.
